HomeMy WebLinkAbout2046 Vacating a Portion of an Alley in Block 2 of National City AdditionORDINANCE N0.2046 AN ORDINANCE VACATING THAT PORTION OF AN ALLEY IN NATIONAL CITY ADDITION BLOCK 2,RESERVING UTILITY EASEMENTS, SETTING FORTH CONDITIONS TO THE EFFEC- TIVENESS OF THE VACATION AND ESTABLISHING AN EFFECTIVE DATE. THE CITY COUCIL OF THE CITY OF PORT TOWNSEND, IN REGULAR SESSION ASSEMBLED, DO ORDAIN-AS FOLLOWS: Section 1. That that portion of the alley lying between Lots 4 thru 11 and Lots 12 thru 19, of Block 2, of the National City Addition to the City of Port Townsend, within the City of Port Townsend, be and the same is hereby'vacated. Section 2. That the City of Port Townsend reserves and retains in the vacated alley, for itself, its successors and assigns, a twelve (12) foot utility easement, running six (6) feet on either side from the centerline of the aforesaid alley, and for the complete length thereof. Section 3. That the vacation of the alley as aforesa~!d is conditioned upon the following: a. No structure shall be built, erected or main- tained at any point within twenty-five (25) feet of the northerly edge of the State Road 20 Right-of-Way, upon or over the lots described above. b. That Lots 4 thru 9; lots 10 thur 13, and lots 14 thru 19, all inclusive, shall remain in common ownership and not severed in anyway or manner, unless legal access is first provided to each lot or lots so that no lot or lots are left without legal access. c. That, prior to publication of this ordinance and its effective date, a Restrictive Covenant shall be executed by the owners of the property described above, in a form and manner acceptable to the City of Port Townsend, providing for each of the above restrictions, that the same run with the land, Page Two Ordinance No. 2046 and that such document cannot be modified or terminated in anyway without the prior approval of the City. Section 4. That this ordinance shall be published after compliance with the conditions set forth herein, and compliance with Chapter 12.20 of the Port Townsend~Municpal Code pertaining to compensation and payment of costs to the City. Section 5. This ordinance shall take effect upon its passage, approval and publication in the form and manner provided by law. Read for the first, second and third times, passed by the City Council for the City of Port TOwnsend and approved by the Mayor the 7th day of October, 1986.
