HomeMy WebLinkAbout071414CITY OF PORT TOWNSEND MINUTES OF THE SPECIAL BUSINESS MEETING OF JULY 14, 2014 CALL TO ORDER AND PLEDGE OF ALLEGIANCE The Port Townsend City Council met in special session the 14th day of July 2014 in the Council Chambers at 540 Water Street. The meeting was called to order at 6:30 p.m. by Mayor David King. ROLL CALL Councilmembers present at roll call were Pamela Adams, Robert Gray, David King, Kris Nelson, Catharine Robinson, Michelle Sandoval, and Deborah Stinson. Staff members present were City Manager David Timmons, City Attorney John Watts, Public Works Director Ken Clow, Water Distribution/Water Quality Manager Ian Jablonski, City Engineer David Peterson, Senior Planner John McDonagh, Nora Mitchell Finance Director, and City Clerk Joanna Sanders . PUBLIC HEARINGS Six -Year Transportation Improvement Program (TIP) Public Hearing and Resolution 14-041 approving the 2015-2020 Six -Year Transportation Improvement Program and Authorizing the City Manager to Submit this to the State of Washington Mayor King read the rules for the public hearing. Public Works Director Ken Clow gave the staff presentation of the 2015-2020 Transportation Improvement Program. He then responded to questions about projects listed but not yet funded, noting that they remain listed until developed. There was no public comment. City Manager David Timmons pointed out that the lack of a state transportation program and no re -appropriation of federal transportation funding could jeopardize the listed transportation projects. Motion: Catharine Robinson moved to approve Resolution 14-041 approving the 2015-2020 Six -Year Transportation Improvement Program and Authorizing the City Manager to Submit this to the State of Washington. Kris Nelson seconded. Vote: motion carried unanimously, 7-0 by voice vote. City Council Business Meeting July 14, 2014 Page 1 of 3 Ordinance 3112 Adopting Zoning Regulations and Standards Relating to Both Medical and Recreational Marijuana, and Amending Port Townsend Municipal Code Chapter 17.08 Definitions, Chapter 17.16 Residential Zoning Districts, Chapter 17.18 Mixed Use Zoning Districts, Chapter 17.20 Commercial Zoning Districts, Chapter 17.22 Marine - Related and Manufacturing Zoning Districts, and Chapter 17.84 Conditional Uses. Senior Planner John McDonagh gave the staff report, noting Council had a workshop last week on the proposed Port Townsend Municipal Code amendments in six areas of Chapter 17. In addition to reviewing the proposed amendments, he noted two additional provisions on non- commercial collectives and provided alternative language for consideration. The interim regulations would expire in early August unless extended or superseded. There was no public comment. Council discussion and questions related to the following: increasing the age of a designated provider from 18 to 21; explanation on the prohibition for outdoor growing related to protection of youth and concern about the potential for theft; limiting the number of vehicle trips similar to exempt home occupations; allowing non-commercial medical collectives in senior facilities to improve access to medical marijuana; the origins of the 300 -foot buffers in residential areas; clarification of the residential, mixed-use, and commercial zoning use tables, non-commercial collective garden criteria to address enforcement concerns; the potential for future code amendments if there is legislative action to eliminate medical marijuana; allowing medical commercial collectives in the C -II hospital district; a suggestion to change Port zoning for marijuana production and processing to Permitted from Prohibited in the event Port policy changes to allow. Staff noted the need for a correction to the use table in Exhibit D marijuana production and processing from Prohibited to Conditional. The ordinance would be brought back for second reading on July 21 with proposed revisions as discussed. Motion: Kris Nelson moved to approve first reading of Ordinance 3112 Adopting Zoning Regulations and Standards Relating to Both Medical and Recreational Marijuana, and Amending Port Townsend Municipal Code Chapter 17.08 Definitions, Chapter 17.16 Residential Zoning Districts, Chapter 17.18 Mixed Use Zoning Districts, Chapter 17.20 Commercial Zoning Districts, Chapter 17.22 Marine -Related and Manufacturing Zoning Districts, and Chapter 17.84 Conditional Uses (with changes to Exhibit D processing and production as discussed, and accepting the staff recommendation in Exhibit A to use language proposed in item 10A versus 10). NEW BUSINESS 2014 Water System Plan Update Public Works Director Ken Clow gave the staff report on this plan that is required in order to maintain compliance with the Washington State Department of Health (DOH). On August 4, the item would be brought back for public hearing and adoption. The plan covers a three-year period and is only a partial revision. He reviewed changes noting this plan has also been before the Planning Commission with a unanimous recommendation to approve. Once approved by Council, it will be forwarded to DOH for final review and adoption by September 1. Water Distribution/Water Quality Manager Ian Jablonski reviewed the summary sheet of basic planning data, system analysis and capital improvement plan. There was no public comment. Staff responded to Council questions as follows: how well the modeling predicts capacity to deliver, the agreement with Port Townsend Paper in times of water shortages; when growth projections would be adjusted, and when an update would be needed. Mr. Timmons noted that the Public Works Trust Fund requires this plan to be updated in order to be eligible for the 2014 Drinking Water State Revolving Loan Fund. Mr. Clow then gave an update on current flow levels in the Big Quilcene. Weather and rain over the next two months will determine drawdown needed at City and Lords Lakes.
