HomeMy WebLinkAbout14-037 CDBG Application - Mountain View Commons Resolution 14-037 Page 1 of 3 RESOLUTION 14-037 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PORT TOWNSEND, WASHINGTON,AUTHORIZING THE CITY MANAGER TO SUBMIT A COMMUNITY DEVELOPMENT BLOCK GRANT (CDBG) APPLICATION ON BEHALF OF THE JEFFERSON COUNTY FOOD BANK AND WORKING IMAGE TO FUND CAPITAL IMPROVEMENTS AT THE MOUNTAIN VIEW COMMONS WHEREAS, on June 2, 2014, the Port Townsend City Council approved Resolution 14- 025 authorizing submittal of a grant application on behalf of the Jefferson County Food Bank and Working Image to Fund their proportionate share of energy services improvements at the Mountain View commons; and WHEREAS, due to incompatibility with the original scope and the other grants, the State is recommending a revised CDBG application to fund additional Phase 3 capital improvements to Mountain View Commons benefitting the Jefferson County Food Bank and Working Image; and WHEREAS, the City Council determines it appropriate to authorize the City Manager to apply for an amount up to $1,000,000 to fund additional capital improvements; and WHEREAS, the Port Townsend City Council has identified a sustainable future and facility improvements for the Mountain View Commons as a priority in their 3-year Strategic Plan; and WHEREAS, the City has already received grant funding to complete energy service improvements (Department of Commerce) and a clean diesel grant (Department of Ecology) for needed improvements at Mountain View Commons; and WHEREAS, the City of Port Townsend is applying to the state Department of Commerce Community Development Block Grant(CDBG) program for funding assistance targeted at serving low-to moderate income residents, and to fund additional capital improvements to Mountain View Commons for the Jefferson Food Bank and Working Image; and WHEREAS, it is necessary that certain conditions be met as part of the application requirements; and WHEREAS, David Timmons, City Manager, is authorized to submit this application to the State of Washington on behalf of the City of Port Townsend. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Port Townsend authorizes submission of this application to the Washington State Department of Commerce to request up to $1,000,000 to fund Capital Facility Improvements benefitting the Jefferson County Food Bank and Working Image at Mountain View Commons, and certifies that, if funded, it: Resolution 14-037 Page 2 of 3 Will comply with applicable provisions of Title I of the Housing and Community Development Act of 1974, as amended, and other applicable state and federal laws; 1. Has provided opportunities for citizen participation comparable to the state's requirements (those described in Section 104(a)(2)(3) of the Housing and Community Development Act of 1974, as amended); and has complied with all public hearing requirements and provided citizens, especially low- and moderate- income persons, with reasonable advance notice of and the opportunity to present their views during the assessment of community development and housing needs, during the review of available funding and eligible activities, and on the proposed activities; 2. Has provided technical assistance to citizens and groups representative of low- and moderate-income persons that request assistance in developing proposals; 3. Will provide opportunities for citizens to review and comment on proposed changes in the funded project and program performance; 4. Will not use assessments against properties owned and occupied by low- and moderate-income persons or charge user fees to recover the capital costs of CDBG- funded public improvements from low- and moderate-income owner-occupants; 5. Will establish a plan to minimize displacement as a result of activities assisted with CDBG funds; and assist persons actually displaced as a result of such activities, as provided in the Uniform Relocation Assistance and Real Property Acquisition Policies Act of 1970, as amended; 6. Has adopted or will adopt a policy(s) to reduce greenhouse gas emissions in accordance with RCW 70.235.070 and certifies this project will adhere to this policy(s); 7. Will conduct and administer its program in conformance with Title VI of the Civil Rights Act of 1964 and the Fair Housing Act; will affirmatively further fair housing (Title VIII of the Civil Rights Act of 1968); has adopted (or will adopt) and enforce a policy prohibiting the use of excessive force by law enforcement agencies within its jurisdiction against any individuals engaged in nonviolent civil rights demonstrations; and has adopted (or will adopt) and implement a policy of enforcing applicable state and local laws against physically barring entrance to or exit from a facility or location that is the subject of such nonviolent civil rights demonstration within its jurisdiction, in accordance with Section 104(1) of the Title I of the Housing and Community Development Act or 1974, as amended; and 8. Designates David Timmons, City Manager, as the authorized Chief Administrative Official and the authorized'representative to act in all official matters in connection with this application and Port Townsend's participation in the State of Washington CDBG Program. Resolution 14-025 is rescinded.
