AN ORDINANCE VACATING THAT PORTION OF IVY STREET

THE CITY COUNCIL OF THE CITY OF PORT TOWNSEND, IN REGULAR SESSION
ASSEMBLED, DO ORDAIN AS FOLLOWS:
Section 1.
That that portion of Ivy Street, lying between Hastings
Avenue and 29th Street within the City of Port Townsend be and the
same is hereby vacated.
Section 2.
That the street vacation as aforementioned is conditioned
however upon the following:
a. The applicant must obtain an electrical utility ease-
ment for the existing electrical service located west of Ivy
Street, and must grant to the City of Po~t Townsend, its successors
and assigns, a twelve (12) foot wide utility easement from Hastings
Avenue to 29th Street across Block 7 of the Learned's Second Addi-
tion in the City of Port Townsend. Both easements, the exact
location thereof, and the terms and form shall first be approved
by the City Attorney.
b. The applicant must obtain and record a perpetual ease-
ment for legal access to the house and garage located in Block
7 of Learneds Second Addition, or provide legal access to any side
of the garage except the west side, from 29th Street, Hastings
Avenue, or from the alley platted between Spring Street and Ivy
Street, said easement to be approved by the City Attorney.
c. Occupational use of the garage is not permitted with-
out first obtaining a permit for a home occupation pursuant to
Ordinance No. 2059 of the City of Port Townsend.
d. Ail fees and compensation pursuant to Chapter 12 of
the Port Townsend Municipal Code must be paid prior to recording.
Section 3.
This Ordinance shall not be published nor recorded until
the conditions set forth in Section 2 are satisfied and approved
by the City, after which this Ordinance shall take effect upon its
passage, approval and publication in the form and manner provided
by law and will further be recorded with the Auditor
County, Washington.
