STREET LYING BETWEEN SHERIDAN STREET AND
STREET WITHIN THE CITY; ESTABLISHING
THERETO AND AN EFFECTIVE DATE
~HE CITY CODNCIL O~ ~HE CITY OF ~ORT TOWNSEND~ IN
ILAR SESSION ASSEMBLED, DO ORDAIN AS FOLLOWS:
Section 1. That that portion of Ninth Street lying
between Sheridan Street and Wilson Street, within the City of
Port Townsend, be and the same is hereby vacated.
Section 2. That the street vacation as ~forementioned
is conditioned however upon the following:
(A) The applicant Jefferson General Hospital
shall convey an electrical utili:t~, easement to Puget Sound
Power and Light Company to cover Puget Power's underground and
overhead electrical facilities within the area to be vacated.
(B) The applicant Jefferson General Hospital
shall convey to the City, and the City hereby reserves, a twelve
(12) foot wide general utility easement within the area to be
vacated and on an alignment to be first approved by the Director
of Public Works for the City.
(C) The applicant shall perpetually maintain
an emergency vehicle access corridor from both Sheridan and
Cleveland Streets to the emergency room of Jefferson General
Hospital, and the City does hereby reserve such access.
(D) Applicant Jefferson General Hospital shall
complete acquisition of Lots 4 and 5, Block 193, Eisenbeis Addi-
tion to the City of Port Townsend.
(E) Applicant shall pay all fees and compensation
pursuant to Chapter 12 of the Port Townsend Municipal Code prior
to recording of the vacation with the Jefferson County Auditor.
Section 3. This Ordinance shall take effect upon its
passage, approval and publication in the form and manner provided
by law, and after being recorded with the Auditor for Jefferson
County, Washington, and this Ordinance shall not be so recorded
until all conditions set forth in Section 2 hereof have been com-
plied with.
Read for the first, second and third times, passed by
