RESOLUTION NO. 13-036
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PORT TOWNSEND,
WASHINGTON TO AUTHORIZE THE CITY MANAGER TO ENTER INTO A SHARE
OF COST AGREEMENT WITH THE PORT TOWNSEND PAPER CORPORATION
WHEREAS, a September 2012 engineering inspection of the Big Quilcene River
diversion structure documented several structural issues with the timber crib diversion; and
WHEREAS,the abutment structure supporting OGWS transmission line at the Andrews
Creek crossing has eroded over time and needs repair/replacement; and
WHEREAS, failure of either of these structures would jeopardize the flow of water to
the City and the mill; and
WHEREAS,the lease agreement with the Port Townsend Paper Corporation, which
outlines lessee and lessor obligations, does not clearly delineate the difference repair,
replacement and betterments thereby making it unclear which party is responsible for these
repairs/replacements; and
WHEREAS, it is the interest of both the City and the paper mill to see that these
structures are restored to full operating capacity to prevent a catastrophic failure; and
WHEREAS,historically the mill and the City have considered equal cost sharing for
some water system repairs; and
WHEREAS, the Port Townsend Paper Corporation President has agreed to a 50/50 cost
sharing for Andrews Creek and Big Quilcene River diversion repairs,
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Port
Townsend as follows:
Authorize the City Manager to enter into a 50/50 Share of cost agreement with the Port
Townsend Paper Corporation to make necessary repairs to the Quilcene River diversion and
repairs to the OGWS transmission line support system at the Andrews Creek crossing.
ADOPTED by the City Council of the City of Port Tow send at a special meeting
thereof, held this 25th day of November 2013.
