This site visit was intended to fulfill"structural observation"services as defined in section 1702 of the 2003 IBC. The code defines structural observation as:"the visual observation of the structural system by a registered design professional for general conformance to the approved construction documents at significant construction stages and at completion of the structural system. Structural observation does not include or waive the responsibility for the inspection required by Section 109, 1704 or other sections of this code." Therefore this report is simply supplemental to all other required inspections. At the time of the site visit,the framing was mainly completed as well as exterior finishes and roofing material. During the time of the site visit some deficiencies were noted and are summarized below: 1. Two hold downs on the first floor framing plan were not installed at grid l&A.4 and grid 1 and B. The mark for these pieces of hardware is"HD5"and per the hold-down fastening schedule on sheet S1.2 an HDQS-SDS3 should have been installed in this location. These hold downs should be installed 2. Four hold downs were not installed at the lu and 2"d floor framing plans on grid 8 and E_1 and on grid 8 and R.S. Due to the small window opening size at these locations it is acceptable to install two continuous coiled straps above and below the openings at both the4'and god floor levels. Use 2-CS 16 coiled straps with 10d(.148X1.5) nails typically. Install solid blocking behind the CS coiled strapping typically. 3. At the 2"d floor framing plan,East side of the building,the size and extents of the headers are not per plan. RF.f #2 allows for 6X8's in the designated locations. Where the headers are indicated as continuous,but were installed discontinuous,install 2-CS16 coil straps with 10d(.148X1.5)nails typically to create a continuous drag strut element. 4, Two 6060 windows were installed in lieu of a 3040 window at the northwest elevation(grid A)at the 1'`floor level. The work shall be inspected for conformance with the plans and specifications approved by the City. Revisions and addenda sheets will not be used for inspection, unless they have been approved by the City. The special inspector shall report, to the City, any revisions that are not approved. Project History The applicant originally applied for SEPA determination for placement of approximately 750 cu. yds. of fill (later revised to 1,000 cu. yds.) and construction of an approximate 130 foot retaining wall in anticipation of later construction of up to three residential dwellings in a triplex on the hillside between the Franklin Street right-of-way and Jefferson Memorial Field below. The preliminary building footprint was approximately 6,000 square feet with an approximately 1,800 square foot driveway. The site lies within an. Environmentally Sensitive Area(ESA)because of steep slopes some portions of which are well in excess of 40%. It is part of a highly visible bluff adjacent to the Port Townsend Historic District, which is regulated under the Port Townsend Urban Waterfront Plan. The applicant requested the wall and fill be reviewed separately from the subsequent residential construction, but the City determined that based on SEPA regulations regarding phased projects, the project needed to be considered in its entirety, including review of all proposed structures. The SEPA Handbook(2.3.1.1.1 Phased Review) states, ". . .phased review of a project is not appropriate when it would merely divide a project to avoid consideration of cumulative impacts or alternatives. For example, if an industrial facility is proposed, it is not appropriate to limit the review to the impacts of the grade and fill permit without considering construction and operation of the industrial facility. " Due to concerns about compliance with ESA regulations and potential impacts to existing slope and topography, the applicant withdrew the proposal for a retaining wall and fill, and reduced the size of the proposed structure as described below. I. CURRENT PROPOSAL DESCRIPTION Construction of a triplex and Accessory Dwelling Unit (ADU) in an Environmentally Sensitive Area SEPA MDNS/Page 2 Charles Arthur Triplex behind Memorial Field LUP02-064 • (ESA) on an approximately 17,140 square foot parcel. The proposal has been revised to eliminate the wall and minimize cut and fill to the site, which contains steep slopes and some eroded soils. The proposed building footprint including driveway has been reduced to 3,391 square feet, which is within the permitted 20%impervious surface coverage of 3,428 sf allowed for construction in steep slope areas. II. PUBLIC COMMENT Several comment letters and a neighborhood petition signed by 57 residents were received in response to the Notice of Application and Pending Threshold Determination mailed to neighbors on June 26, 2002 (Exhibits C and D). (Revised notice sent on July 31, 2002 regarding increase in proposed fill from 750 to 1,000 cu. yds.) The majority of the comments expressed concerns about the stability of the hillside and that the proposed development would negatively impact the character of the highly. visible bluff, eliminate wildlife and bird habitat, and increase traffic along Monroe Street. Jefferson County Public Works commented that, while not opposed to the proposal, the site is adjacent to Jefferson Memorial Field and residents of the proposed building will be subjected to the. noise and lights of the many day and evening events held at the facility. County staff expressed concerns that a new residential development so close to the facility would invite noise and light complaints about events occurring at Memorial Field. These concerns are addressed in Section H— "Noise" below. III. PERMITS/APPROVALS REQUIRED PRIOR TO CONSTRUCTION: • Street & Utility Development Permit • Building Permit IV. RESPONSIBLE OFFICIAL'S AMENDMENTS TO CHECKLIST ITEMS The Applicant's environmental checklist is hereby incorporated by reference. The following discussion is intended to address potential environmental impacts not addressed by the environmental checklist. A. EARTH The site is classified as an Environmentally Sensitive Area(ESA) due to steep slopes and erosion hazard. Conformance with ESA regulations is discussed in detail under Section LAND AND SHORELINE USE. In addition to the environmental checklist the applicant provided an Updated Geotechnical Report prepared by Northwestern Territories, Inc. on February 21, 2002. The US Soil Conservation Service (SCS) Soil Survey for Jefferson County lists the soils on the site as TnC Townsend Series soils described as 24 to 36 inches of black gravely loam over a very compact glacial till. This soil type is described as well-drained,with permeability moderate above the cemented layer. Runoff is slow to medium and the hazard of water erosion is slight to moderate. There has been considerable erosion on the site due to a city stormwater pipe which discharges water in the vicinity of the Franklin Street right-of-way. Also, stormwater from other uphill properties may drain onto the site. The applicant has requested that the City repair and reroute the stormwater flowing out of the pipe in the Franklin Street right-of-way. The City Public Works Department has agreed to reroute the stormwater from SEPA MDNS/Page 3 Charles Arthur Triplex behind Memorial Field LUP02-064 the pipe, but cannot guarantee that stormwater from other uphill sites will not continue to flow onto the property. The NTI report describes the lower portion of the property, where the triplex is proposed to be located, to have poorly consolidated soils which are subject to further settlement The report concludes that the foundation for any structure must penetrate below this poorly consolidated material. The report indicates the site may also have been filled with dredge spoils and other material in the past, and natural peat deposits may occur under portions of the property. The site will be disturbed through construction of the triplex, driveway, stormwater and utility improvements. The applicant has reduced the size of the triplex and minimized the driveway to ' reduce impact to the steep slope. An engineered foundation designed by a licensed structural engineer will be required to address soil, foundation, and slope issues. The applicant will be required to conduct soil testing sufficient to properly design and construct the foundation. To mitigate potential adverse impacts to earth, the applicant will prepare a temporary erosion and sedimentation control(TESC) plan utilizing Best Management Practices and complying with the City's Engineering Design Standards. Once approved by the Public Works Department, the applicant must adhere to the TESC plan during facility construction. B. AIR The environmental checklist description concerning air is adequate. During construction, emissions from heavy equipment and vehicles associated with the development will be created. Should dust become a problem during construction, water shall be applied as a suppressant. Upon project completion& occupancy, automotive traffic to and from the three residences will generate on-going exhaust emissions. No significant adverse impacts are anticipated. C. WATER The environmental checklist, supplemented by a preliminary stormwater plan is generally adequate_ Surface Water No surface water exists on or within 200 feet of the project site. Stormwater Runoff There has been a problem with stormwater runoff onto the site from a stormwater pipe above the site in the Franklin Street right-of—way. There may also be runoff onto the site from other developed private properties located upslope. The applicant has requested that the City repair and reroute the stormwater flowing out of the pipe in the Franklin Street right-of-way. The Public Works Department has agreed to reroute the stormwater from the pipe to Monroe Street, but cannot guarantee that stormwater runoff from private uphill properties will not flow onto the property. The applicant has submitted a preliminary stormwater management plan for the original proposal (Exhibit C). A final stormwater plan will be required as part of the Street and Utility Development Permit. D. PLANTS The environmental checklist description with regards to plants is adequate. Brush including scotch broom, blackberry, wild rose, and snowberry will be removed as part of the construction. No SEPA MDNS/Page 4 Charles Arthur Triplex behind Memorial Field LUP02-064 • threatened or endangered plant species have been observed on site. Vegetation outside the construction area must be disturbed as little as possible in order to help maintain slope stability and to maintain the appearance of the slope. No vegetation in areas of greater than 30% slope may be removed except for diseased or hazardous trees. E. ANIMALS Comment letters noted that the site provides bird and wildlife habitat. Although birds and other wildlife may use the hillside, no threatened or endangered animal species have been observed on site. The following species and their habitats are protected in Port Townsend: bald eagles, great blue herons, brant and harlequin feeding areas, and waterfowl at Kah Tai lagoon and the golf course pond. No impacts to threatened or endangered animal species or habitat is anticipated at this site. It should be noted that river otters have been reported on site, presumably moving upland from Point Hudson. Based on consultation with the Department of Ecology(DOE) staff, river otters generally are seen on upland sites when they are denning. There may, therefore, be a den onsite or in the vicinity. According to the DOE, river otters can be very difficult to relocate once they have established a denning site, and they may continue to use the property even after it is developed. F. ENERGY& NATURAL RESOURCES The environmental checklist description with regards to energy& natural resources is adequate. There are no mineral or energy resources known to exist on the site. The proposed structure will be required to meet the Washington State Energy Code. G. ENVIRONMENTAL HEALTH The environmental checklist description with regards to environmental health is adequate. Standard construction practices shall be employed to minimize the risk of environmental health hazards including explosion and the release of hazardous materials. Standard construction and traffic control measures should be employed to minimize the risk of accidents. H. NOISE Noise impacting the proposed development: Noise from frequent sporting and other public events at Jefferson Memorial Stadium potentially will impact the residential use of the site. The City received a letter from Jefferson County Department of Public Works(Exhibit F) noting that Memorial Field is an active recreation site that has been used for approximately 50 years that hosts approximately 200 to 250 events per year, including carnivals, sports camps and games, circuses and special events- The baseball diamond is located directly adjacent to the property. While Jefferson County Public Works is not opposed to development of the property, they are concerned that new residents will generate complaints about noise, lights, and errant baseballs. The property owner will be required to sign a "No Protest Agreement" binding upon future owners acknowledging that the property is subject to the noise, light, traffic and other aspects of living directly adjacent to a public facility of this type. Noise impacts created by the proposed development. During construction, surrounding properties would be subject to traffic and heavy equipment noise. All construction equipment shall be required to have mufflers. Per the City's Engineering Design Standards, hours of construction shall be limited to between 7 a.m. and 6 p.m. Monday through Friday, and prohibited on weekends and national SEPA MDNS/Page 5 Charles Arthur Triplex behind Memorial Field LUP02-064 • I holidays. Under special circumstances, and if requested in advance, the BCD Director may grant exceptions to these construction hour limits. No additional mitigation is required. I. LAND and SHORELINE USE Zoning The project site is located in the R-II Residential Zoning District. The R-II district accommodates single-family residences at a density of one per 5,000 square foot area. Since the parcel is over 17,000 sf, the underlying zoning density allows 3 dwellings. Because of the steep slopes, the most feasible way to accomplish that density is a triplex. A triplex is also entitled to one Accessory Dwelling Unit (ADU) provided the property owner lives on the site. Condominium type ownership is allowed in the R-II district. If the proposed triplex is divided into condominium ownership, ownership of the ADU msut be attached to ownership of one of the three condo units. Special Overlay District The BCD Director, who is the SEPA responsible official, has concluded that the site lies within the Port Townsend Urban Waterfront Planning Area, but that it is not clearly located within the"Special Design Review Overlay District"under PTMC Chapter 17.30, and thus is not subject to mandatory Historic Preservation Committee review. However, SEPA"substantive authority" may be invoked to mitigate impacts to the historic commercial district and view corridors. See Section K. AESTHETICS for discussion. Shorelines/Environmentally Sensitive Areas(ESA.$) ESA goal of minimizing site modification Relevant Development Regulations: The ESA ordinance takes as its basic approach the `Avoid, Reduce, Compensate method' that is, "first, if at all possible, avoid adverse impacts; second, if that is not reasonable or possible reduce adverse impacts by minimizing or limiting the degree or magnitude of the development and its implementation by using appropriate technology, or by taking affirmative steps to avoid or reduce impacts. "(PTMC 19.05.010.B) A minimum buffer of 25 feet shall be provided from the edge of all slopes and marine bluffs that are subject to landslide or erosion hazards. (PTMC 19.05.100.E.1) The buffer may be reduced when expert verification and environmental information demonstrate to the satisfaction of the director that the proposal will not adversely impact a sensitive area. (PTMC 19-05-100-E.3) Discussion: The subject property is privately owned and is thus subject to development within the confines of ESA and other relevant regulations as discussed herein- In response to City feedback, the applicant has eliminated the large wall and extensive fill and reduced the size of the structure in order to lessen the overall impact of the project. He has also eliminated the portion of the building originally located in the steeper area on site. However, strict adherence to the standard of a 25 foot buffer from the toe of the slope would tend to make the building appear more massive from every viewpoint by moving it further southward, rather than blending into the background of the bluff. The BCD Director has determined that the buffers as shown on the preliminary site plan are acceptable and with appropriate engineering and mitigations, are not anticipated to impact the slope. The buffers of the SEPA MDNS/Page 6 Charles Arthur Triplex behind Memorial Field LUPO2-064 • r final plan shall not be less than as shown on the preliminary site plan. l t Steepness of slope/Lot coverage Relevant Development Regulations: The maximum total percentage of lot area that can be covered by impervious surfaces, (including parking areas) is limited by the slope of the lot for all detached single-family developments as follows: Lot slope X30%allows Lot Coverage 20% (PTMC 19.05.060.A.5.a); Minimize footprint of building and other disturbed areas within the steep slope area; use common access/utility corridors where feasible (PTMC 19.05.100.D.2.d.i.); Minimize impervious lot coverage and where feasible incorporate under-structure parking and multi- level structures(PTMC 19.05.100.D.2.d.ii.); The director may waive the maximum lot coverage if the proposal minimizes impacts to . environmentally sensitive areas...and...uses preferred practices, outlined in subsection A.3 of this section, which are appropriate for the lot(PTMC 19.05.060.A_5.b.i); All possible efforts should be made to ensure that land surface modifications would not induce excessive erosion, destabilize adjacent lands or scar the landscape (PTMC 19.04.180.B.5); In area of former or active landslides and along slopes determined to be unstable, no land modification or related activities should occur without a favorable geologic investigation demonstrating that hazardous conditions do not exist or that mitigation techniques can be used to ensure safety to life and property. (PTMC 19.04.180.B.11); All proposed development on slopes greater than 40%over a vertical height of at least 10 feet should be avoided if possible. (PTMC 19.05.100.D.2.Lii); Alterations to the toe of steep slopes must conform to specific recommendations in the geologic report(PTMC 19.05.100.D.2.f.ii) [if slopes X40%]; Where slopes >50%, no development is allowed and no impervious surfaces permittedd, unless reports show that health and safety are not compromised(PTMC 19.05.110.D.2.fiii); Discussion: The site's lot area is 17,141 square feet. Twenty percent lot coverage, per PTMC 19.05.060, allows 3,428 sf maximum impervious surface. The revised proposal is for a 3,391 square foot building footprint including less than 500 square feet of driveway on site. Therefore, the new proposal meets the 20% maximum impervious surface requirement. The applicant has provided a geologic report which states, "The steep slope gives way to a flatter area in the lower part that may be the site of a structure.- (1 993 NTI report, page 1). The footprint of the structure has been revised so that it sits in the flatter portion of the site. Except for the northernmost corner of the building, all portions of the structure lie within areas of less than 30% slope. The report also states, "The foundation system and available area for construction would SEPA MDNS/Page 7 Charles Arthur Triplex behind Memorial Field LUP02-064 i seem to limit the use of the property to a modestly-sized structure."(1993 NTI report, two references, pages 3 and 4). While the report does not include a definition of"modest", the applicant must meet the impervious surface/lot coverage requirement of 20%. The foundation must be specially designed for the site. The applicant is proposing preferred construction practices such as understory parking, a single access driveway, and maintaining consolidated areas of natural topography and vegetation. Disturbance of site Relevant Development Regulations: Building pad and disturbed areas should be located outside of sensitive areas and buffer boundaries. (PTMC 19.05.060.A.3.e); To reduce the risk of landslide and erosion, the following maximum slope disturbance factors are recommended and may be required: Slope 25-39%, allowed Slope Disturbance is 45%;for Slope >40%, Slope Disturbance may be 30%. (PTMC 19.05.100.D.2.b.v); The revised site plan meets the criteria for slope disturbance by locating the building away from the steepest part of the slope and minimizing the area disturbed. Protection of existing topography and maintaining character of ESA site Relevant Development Regulations and Policies: Proposed actions within environmentally sensitive areas should be managed according to their compatibility with natural characteristics and constraints(PTMC 19.04.180.B.); Structure shall conform to natural contour of slope and foundations should be tiered where possible to conform to existing topography of site; access shall be in the least sensitive area; (PTMC 19.05.100.D.2.d.iii); View Corridors Guideline: Designs shall protect views of the water and the Bluff through compliance with the Shoreline Master Program, the Special Height Overlay District Regulations set forth in Chapter 17.yy of this Code, and other design guidelines established in this chapter. (Urban Waterfront Plan, Guideline 2.2); Environmentally sensitive area goals and policies: Goals. To recognize the unique natural constraints and characteristics of sensitive areas and to maintain or enhance the quality of such areas(PTMC 19.04.180.A.2); Retain characteristics compatible with the natural neighborhood environment(PTMC 19.0 5.060.A.7_b.i ii); Discussion: Port Townsend's steeply sloping topography plays a significant role in shaping the community's image and identity. The impacted slope is an important component of the downtown character and was specifically included in the Port Townsend Urban Waterfront Planning Area. The applicant has revised the proposal to work more with this unique and important site feature. The structure has been located to minimize soil disturbance and where slopes are less than 30%. SEPA MDNS/Page 8 Charles Arthur Triplex behind Memorial Field LUP02-064 • • Shorelines The proposed facility does not lie within 200 feet of a regulated shoreline, water body, or jurisdictional wetland. J. HOUSING The environmental checklist description with regards to housing is adequate. Three market rate single-family dwelling units and one ADU are proposed within a triplex structure. A triplex is considered single-family housing and may have one associated ADU if a property owner resides on site. As noted, the units may be converted to condominium type ownership. No existing housing units will be displaced. K. AESTHETICS The project site is located within the Port Townsend Landmark Historic District, within the Urban Waterfront Planning Area, and adjacent to the downtown Historic Commercial District (C-IlI). Although zoned R-2 Medium Density Residential, the project site is a highly visible portion of the bluff contiguous to and highly visible from the historic commercial district. The site is located within the area protected as a view corridor in the Urban Waterfront Plan, which states: "Designs shall protect views of the water and the bluff though compliance with the Shoreline Master Program, the Special Height Overlay District Regulations as set forth in Chapter 17_yy of this Code, and other design guidelines established in this chapter. " (Urban Waterfront Plan, Guideline 2.2) However, the site is not clearly located within the"Special Design Review Overlay District" under PTMC Chapter 17.30, which requires mandatory design review before the Historic Preservation Committee for all new construction projects. Also, single-family residences normally exempt from the HPC design review process. Therefore, the SEPA responsible official has concluded that this project is not subject to mandatory HPC review and compliance. However, due to potential adverse environmental impacts to the bluff and adjacent downtown historic district resulting from the placement, bulk, and design of the proposed project, the SEPA responsible official will apply those provisions of the Urban Waterfront Plan and Chapter 17.30 through SEPA substantive authority (PTMC 19.04.260)to mitigate identified impacts to the Historic District and Urban Waterfront planning area. Restrictions on building height, maximum building footprint, design of foundation, and reasonable compatibility of the building with the bluff and surrounding structures are required in order to accomplish the above goals as well as to protect the slope. A height restriction will be imposed to minimize impacts to views of the bluff. In this case, "height restriction" means both that the structure must meet the City's building height regulations for the R-II zoning district, and that the building must be located such that the top of the bluff is not obscured nor overwhelmed by the mass of the building. For purposes of the zoning code, height is measured in two ways as follows: If the ground slopes less than 10 feet in the distance measured 5 feet from each side of the building(from highest point of building site to lowest), the building height is measured from the ground on the higher side of the building. If the ground slopes more than 10 feet in the distance measure 5 feet from each side of the building(difference in slope height exceeds 10 feet), the building height is measured from the ground as the lower side of the building,plus 10 feet. In both cases for zoning purposes, the high point of the building is measured at the average height of the highest gable(on a gable type roof), or the top of the SEPA MDNS/Page 9 Charles Arthur Triplex behind Memorial Field LUP02-064 • • roof on a flat type roof. In the present case, because the difference in slope exceeds 10 feet, the building height would be measured from the lower side of the building plus 10 feet. The top of bluff adjacent to the project site is described as approximately 70 feet above sea level. To mitigate impacts to views of the bluff, any proposed structure shall both conform to the R-11 height requirements, using the City's method of determining building height, and also be located such that the highest point of the structure shall not exceed an elevation of 64 feet above sea level in order to avoid obscuring views to and from the bluff. The proposed preliminary building elevations (Exhibit B) are acceptable in regard to building height and placement The applicant has indicated that materials used would be similar to those used in the surrounding neighborhood on residential buildings. L. LIGHT AND GLARE Light and glare impacts to the project: The environmental checklist description of light and glare is not adequate. The project is adjacent to an athletic field that frequently hosts nighttime, highly lit events. To mitigate potential complaints regarding normal use and operation of Memorial Field and notify future property owners of these activities, the applicant shall record a No Protest Agreement, binding on all future owners and residents, that restricts complaints on the basis of light impacts from Jefferson Memorial Field. Light and glare impacts originating from the project: No significant impacts are anticipated. All exterior lighting shall be shielded and directed downward to prevent glare from affecting adjacent properties, pedestrians and motorists. M. RECREATION The environmental checklist description regarding recreation is adequate. The site is within walking distance of many of the recreational attractions of Port Townsend. It overlooks and is adjacent to the downtown Historic Commercial District, and is located within a few hundred yards from Point Hudson and beach access. It is across the street from the skateboard park and adjacent to Memorial Field. The mitigation measures included in this determination shall ensure that recreational opportunities at Memorial Field are not impacted by this project. N. HISTORICAL AND CULTURAL RESOURCES The environmental checklist description concerning historical and cultural resources is adequate. No known cultural or historical resources are known to exist on the site. If such materials are discovered during excavation,work must be stopped immediately and the State Historic Preservation Officer contacted. Work would not be allowed to resume until approval is obtained from the BCD Department. O. TRANSPORTATION Vehicular Primary vehicular access to the parcel will be provided by a short driveway partially in the unopened Franklin Street right-of-way, exiting onto Monroe Street. The driveway has been placed to parallel and minimize intrusion into the hillside; however, the driveway will need paving because of the slope. SETA MDNS/Page 10 Charles Arthur Triplex behind Memorial Field LUP02-064 • A small portion of the hillside to the north of the proposed driveway may need to be excavated in order to allow adequate sight distance for vehicles exiting the site, especially because of event-related, heavy pedestrian and vehicular traffic on Monroe Street. The sight distance must be approved by the Public Works Department as part of the Street and Utility Development permit. Traffic generated by the completed project could be expected to be 40 trips per day total (4 dwelling units x 10 trips/day)based on Institute of Transportation Engineers reference publication, Trip Generation. Since household size in Port Townsend averages 2—3 individuals, that estimate can be downsized to approximately 32 total trips per day. Actual trip generation is expected to be lower due to the downtown location of the site. No adverse traffic impacts are anticipated. Park Eight off-street, parking spaces will be provided for residents and visitors on the ground floor under the residential units. ESA regulations encourage under-structure parking to reduce impervious surface and other site disturbance of the ESA. Five spaces are required by City code per PTMC 17.76.80, which requires 1.5 spaces for each of the three units; no additional parking is required for the ADU under City code. The additional parking spaces above the minimum required will not increase the building footprint or create additional impervious surface. Due to demands for on-street parking adjacent to this site, having additional off-street parking for guests will be helpful since the Memorial Field vicinity often experiences parking and traffic congestion, especially during festivals, sporting and other special events. Transit Jefferson.County Transit shuttle bus serves Monroe Street. There is an unmarked bus stop at the intersection of Monroe and Jefferson Street, within 100 yards to the south of the site. Non-Motorized A public trail could conceivably be built in Franklin Street. However, it may not be advisable to do so because of steep slopes. The Public Works Department will consider that possibility when it repairs the stormwater pipe in the Franklin Street right-of-way. P. PUBLIC SERVICES The environmental checklist description concerning public services is adequate_ Q. UTILITIES The environmental checklist description regarding utilities is adequate. Water and sewer service are available in Monroe Street. Connection to these facilities will be adequately addressed through the Street and Utility Development permit process in compliance with the City's Engineering Design Standards. New development requires a fire hydrant within 250 feet of the property; a new hydrant may be required as determined by the Public Works and Fire Department. The Fire Department must establish fire flow requirements for the project. It will be the applicant's responsibility to demonstrate compliance before a building permit is issued. Stormwater issues are addressed under Section C - "Water" above. SEPA MDNS/Page 11 Charles Arthur Triplex behind Memorial Field LUP02-064 0 REQUIRED MITIGATION MEASURES FOR Charles Arthur Triplex behind Memorial Field FILE NO. 02-064 March 19, 2003 The environmental review indicates a probability of significant adverse environmental impacts from the proposal, which can be mitigated. The following measures are intended to mitigate adverse environmental impacts disclosed during SEPA review. If the proponent agrees upon these recommendations, issuance of a Mitigated Determination of Non- Significance is appropriate. PRIOR TO ISSUANCE OF A BUILDING PERMIT: 1. Any proposed structure shall be designed with an engineered foundation designed by a licensed structural engineer and in conformance with the requirements and recommendations of the geotechnical report. Soil testing sufficient to adequately ensure the sound construction of the structure shall be conducted. 2. All the recommendations of the geotechnical report are incorporated herein by reference, except for references to a retaining wall. 3. Development requirements for any proposed structure: a. To mitigate impacts to the ESA and to reduce stormwater impacts, the footprint of the building plus all impervious surfaces on-site shall not exceed 3,428 square feet, as shown Sail in Exhibit B, which is within the 20% maximum lot coverage/impervious surface. No subsequent development or improvement shall be permitted that exceeds the 20% lot coverage/impervious surface maximum. b. To mitigate impacts to the ESA, the building footprint shall be located no further north or west, that is, closer to the steep slope, than is shown on the Exhibit B. c. To mitigate impacts to views of the bluff, any proposed structure shall both conform to the R-II height requirements, using the City's method of determining building height, and i also be located such that the highest point of the structure shall not exceed an elevation 'Y~ of 64 feet above sea level in order to avoid obscuring views to and from the bluff The proposed preliminary building elevations are acceptable in regard to building height and / placement. d. To reduce impervious surface and disturbance of an ESA, all offstreet parking shall be provided under or within the structure. e. To mitigate for visual impacts of the bluff and adjacent historic commercial district, BCD will review the design of the building for compatibility with adjacent residential and historic commercial development. The preliminary building elevation with barrel roof is 0,, acceptable. If the design is changed, it must be approved by the Building and Community Development Dept. The building shall be designed to fit into the context of the existing surroundings and be a good"background" building, which respects and SEPA MDNS/Page 12 Charles Arthur Triplex behind Memorial.Field IIIP02-064 • S supports existing,structures, rather than an"image"building which departs significantly in architectural style from either surrounding residences or commercial buildings. Exterior siding and trim materials shall be wood, wood-cement products, stonework or brick. Roofing materials shall be dark colored and non-reflective. Synthetic or artificial materials are discouraged. Colors shall be earthtones, tertiary colors or chosen from the Historic Preservation Committee approved color palette. Bright colors shall be used sparingly and only for trim elements. f. To mitigate impacts to the ESA and to ensure good communication between the City and the applicant, a pre-construction meeting must be held onsite with City staff prior to construction. 4. To mitigate potential water and soil erosion hazards, plans for clearing, grading and temporary erosion and sediment controls shall be submitted to the BCD in the Street Development Permit. The plans shall include special attention to prevention of landslides or erosion of the hillside. Grading shall be the minimal required to complete construction. All plans shall be reviewed for / compliance with the Port Townsend Engineering Design Standards and the Department of d Ecology Stormwater Management Manual (DOE SWMM). Temporary erosion and sediment control measures shall be installed as specified by the approved plans before beginning clearing and grading activities and shall be maintained until the city Public Works Department deems them unnecessary. 5. The driveway impervious surface shall be minimized and located substantially as shown on the preliminary site plan. Adequate sight distance must be provided for entrance onto Monroe Street. Some excavation of the hillside on the northern edge of the driveway at the Monroe Street sidewalk will be required. Plans for such excavation and improving visibility must be submitted to and approved by the Public Works Department. 6. A final stormwater management plan must be submitted, prior to the issuance of a building permit. This plan must comply with the requirements of the Department of Ecology Stormwater Management Manual and the Port Townsend Engineering Design standards. 7_ The applicant shall sign a"Hold Harmless" statement in which the owner acknowledges the risks inherent in building on this site, and in which he accepts and assumes all risks of loss or damage arising out of the conditions described herein, and further agrees to relieve and hold harmless the City of Port Townsend, its officers, agents, and employees, of any liability for approval of the development and the engineering design of the development. S. The applicant shall sign a"No Protest Agreement" that shall be binding on all owners and occupants of the structure. This agreement shall acknowledge that Jefferson Memorial Field is the site of frequent community events that generate noise and light, and that the occupants shall not make nuisance complaints about such legal activities. The owners further accept responsibility for any damages due to objects such as flying baseballs that may leave the field in the normal course of sporting events. This agreement does not restrict the right of the owners or SEPA MDNS/Page 13 Charles Arthur Triplex behind Memorial Field T,UP02-064 • occupants to seek redress from illegal or criminal activities that may occur in connection with such events. Nor does the No Protest Agreement restrict the right of the applicant or subsequent property owner from objecting to proposed development on Memorial Field beyond the current uses or existing improvements. DURING CONSTRUCTION 9. Exterior construction activities shall occur only during the dry season or during periods where there is no concern for slope stability as determined by the applicant's engineer. Disturbed areas must be revegetated or otherwise stabilized prior to the start of the rainy season in order to minimize the possibility of erosion and sloughing. 10. No vegetation shall be removed except for the absolute minimum required for construction_ Vegetation may be removed only during the months of May 1"through September 30 unless specifically approved by the Director. Any replanting that is necessary shall be with drought- tolerant, preferably native species. Only minimal irrigation is permitted. 11. To mitigate potential impacts to archeological resources that may be discovered during excavation, work should be stopped immediately if such materials are discovered and the State Historic Preservation Officer contacted immediately. Work should not resume until approval is obtained from the Director of Building and Community Development. 12. A copy of these mitigation measures shall be given to and read by the project contractor and all sub-contractors prior to beginning construction, and a list of these mitigation measures shall be prominently posted at the site in a waterproof container or bag. ONGOING 13. Vegetation standards applied during construction shall be continued once the building is occupied. Native vegetation shall not be disturbed on slopes over 30%. Only drought tolerant plants that require a minimum of irrigation shall be used on site. 14. Condominium type ownership is allowed in the R-II district. If the proposed triplex is divided into condominium ownership, ownership of the ADU must be attached to ownership of one of the three condo units. I, Charles Arthur, have read, understand, and accept the conditions associated with the above referenced mitigated determination of Non-Significance(MDNS). I agree to follow the above referenced.
