RESOLUTION NO. 06-027
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PORT TOWNSEND,
WASHINGTON, DECLARING CERTAIN FIRE DEPARTMENT ASSETS SURPLUS, IN
CONNECTION WITH FIRE SERVICE CONSOLIDATION WITH JEFFERSON
COUNTY FIRE PROTECTION DISTRICT NO.1
WHEREAS, the City of Port Townsend ("City") and Jefferson County Fire Protection
District No.6 entered into an Agreement dated January I, 2005 to jointly manage and operate the
City Fire Department and Jefferson County Fire Protection District No.6; and
WHEREAS, the City, and Jefferson County Fire Protection District No.6, and Jefferson
County Fire Protection District No.1 entered into an Agreement effective June 1, 2005 to jointly
manage and operate the City Fire Department with Jefferson County Fire Protection Districts No.
I and No.6; and
WHEREAS, in November of2005, Jefferson County Fire Protection District No.6
merged into Jefferson County Fire Protection District No.1, which resulted in a two party
agreement between the City and Jefferson County Fire Protection District No.1; and
WHEREAS, City and Jefferson County Fire Protection District No.1 by Agreement
effective January 1, 2006, modified and superceded their Agreement (effective June 1,2005) to
take further steps toward joint operations, by establishing, among other things, a joint operating
fund that has resulted in a contract for Fire/EMS service to the City from Jefferson County Fire
Protection District No.1; and
WHEREAS, in RESOLUTION NO. 06-011 (approved May I, 2006), the Council
confirmed its intention to further joint fire service operations with Jefferson County Fire
Protection District No. I, and directed the City Manager, in consultation with the Fire Chief, to
negotiate mutually agreeable agreements for Council review and approval, as follows:
I. Agreement to transfer ownership of all rolling stock and equipment, and assets, held by the
City Fire Department (based on inventory) to the District; and
2. Agreement to transfer City Fire Department employees to the District; and
3. Agreement for term lease with the District for the use of the City Fire Hall; and
WHEREAS, the Council determines the consolidated operation of the fire services of the
City and Jefferson County Fire Protection District No.1 to date has been successful and provided
efficiencies and benefits to the citizens of the City, including, by taking advantage of economies
of scale, reducing duplication of costs and downsizing administrative positions, and the Council
determines agreements for transfer of equipment, lease and transfer of the fire hall, and transfer
of employees would provide a more concrete and stable partnership and unified operation; and

WHEREAS, the Council determines it appropriate to accomplish further consolidation of
the fire protection and EMS Services into one joint operation, to streamline the administrative,
operational, and financial functions of the Fire Department, by disposing of the equipment and
vehicles listed in this Resolution to the Jefferson County Fire Protection District No. I, leasing
and transferring the fire hall to Jefferson County Fire Protection District No. I, and transferring
City fire service employees to Jefferson County Fire Protection District No.1, according to the
terms of this Resolution; and
WHEREAS, the Council on October 16,2006 approved in concept further consolidation
measures, with final action to follow a public hearing on property surplus; and
WHEREAS, following the procedures for disposition of personal property as required by
law, including Ch, 39.33 RCW Intergovernmental Disposition of Property, and having held a
duly advertised public hearing on November 6,2006.
NOW, THEREFORE, BE IT RESOLVED by the City Council ofthe City of
Port Townsend as follows:
A. The Council determines the equipment and vehicles listed in the attached Exhibit A are
surplus, with the intent to transfer and consolidate certain assets to facilitate the Interlocal
Agreement between the City and Jefferson County Fire Protection District No.1. The Interlocal
Agreement demonstrates that the City has or soon will have no practical, efficient, or appropriate
use for the property, or have such a use for the property in the near future, and it is appropriate to
transfer this property to the Jefferson County Fire Protection District No.1, as part of the
consolidation of fire services, according to the terms separately approved by Council, and subject
to a reversion clause on termination or de-annexation.
B. The Council determines the real property and improvements known as the fire hall, located at
701 Harrison Street, Port Townsend, W A, is surplus with the intent to lease and/or transfer the
real property to facilitate the Interlocal Agreement between the City and Jefferson County Fire
Protection District No.1. Under the terms of the Interlocal Agreement, the City will have limited
practical, efficient, or appropriate use for the property, or have such a use for the real property in
the near future. It is appropriate to lease this property to Jefferson County Fire Protection District
No.1, according to the terms separately approved by Council. The terms include: The District
shall lease the real property at 120% of the associated property debt, as well as assumption ofthe
legal responsibility and maintenance of the real property. If there is City annexation to the Fire
District, the real property will be transferred to the Fire District, in fee simple subject to: 1) the
District covers all remaining debt; and 2) the District must use the real property as a fire hall in
perpetuity; and 3) if following an annexation, the City "de-annexes" from the District, then the
fire hall returns to the City at no cost or fee.
