GRANT OF EASEMENT
THIS GRANT OF EASEMENT is made this day of 1997, by
WAYNE HOWELL and BARBARA HOWELL, husband and wife, ("Grantor")for the benefit of THE
CITY OF PORT TOWNSEND, a Washington municipal corporation and statutory city of the second
class, and its assigns ("Grantee"), as follows:
For and in consideration of the sum of TEN DOLLARS ($10.00) and other good and
valuable consideration, the receipt and adequacy of which is hereby acknowledged by Grantor,
Grantor hereby grants and conveys to Grantee the perpetual right in the nature of an easement
over, upon, across, under and through the real property of Grantor described in Exhibit A attached
hereto and incorporated herein by this reference for the construction, installation, use,
maintenance, repair, and replacement of an existing water main and related appurtenances,
including a right of access through adjacent land of Grantor for construction purposes, such right
of access being limited to the duration of Grantee's construction activities. Grantee shall restore
Grantor's property to its condition immediately prior to the exercise of any rights granted hereby.
The easement hereby granted and conveyed is ten (10) feet in width, being five (5) feet on
each side of the centerline of the existing water main and five (5)feet on each side of the centerline
of the existing service line to a residence in Block 82 of the Supplementary Plat of Captain Tibbals
Lake Park, as per plat recorded in Volume 2 of Plats, page 3, records of Jefferson County,
Washington. It is intended that Grantee shall have direct and immediate access to the water main,
service line and other related appurtenances at all times; no structures or other substantial
improvements may be erected within the easement.

EXHIBIT A
Those portions of the rights of way for Maple Street, Belle Street, and Elm Street as dedicated in
the Supplementary Plat of Captain Tibbals Lake Park, as per plat recorded in Volume 2 of Plats,
page 3, records of Jefferson County, Washington, that attached to the most Northerly portion of
Block 20 of said plat by operation of law upon vacation of said rights of way pursuant to Section
32, Ch. 9, pg. 603, Laws of 1889-1890, now codified as RCW 36.87.090.
