GRANT OF EASEMENT
THIS GRANT OF EASEMENT is made this day of June- , 1998, by WILLIAM W.
GRACE, SR., as Trustee of the William W. Grace, Sr., Trust, as to an undivided one-half interest, and
L'WANA M. GRACE, as Trustee of the L'Wana M. Grace Trust, as to an undivided one-half interest,
("Grantor")for the benefit of THE CITY OF PORT TOWNSEND, a Washington municipal corporation,
and its assigns ("Grantee"), as follows:
For and in consideration of the sum of TEN DOLLARS ($10.00) and other good and
valuable consideration, the receipt and adequacy of which is hereby acknowledged by
Grantor, Grantor hereby grants and conveys to Grantee the perpetual right in the nature
of an easement over, upon, across, under and through that portion of Lot 12 in Block 4
of National City No. 1, as per plat recorded in Volume 2, page 150, records of Jefferson
County, Washington, and that portion of the right of way for Third Street, as dedicated
in said plat, that was vacated by City of Port Townsend Ordinance No. 2477, as
described in the attached Exhibit A which is incorporated herein by this reference. The
easement conveyed and granted hereby is for the construction, installation, use,
maintenance, repair, and replacement of stormwater utility facilities, and for slope
stabilization and landscaping purposes in connection with a wetland enhancement
program, including a right of access through adjacent land of Grantor for construction
purposes, such right of access being limited to the duration of Grantee's construction
activities. Grantee shall restore Grantor's adjacent property to its condition immediately
prior to the exercise of any rights granted hereby.

That portion of Lots 12, 13, 14, and the Westerly 7.69 feet of Lot 15 in Block 4, National City
No. 1, as per plat recorded in Volume 2 of Plats, page 150, records of Jefferson County,
Washington, together with that portion of the right-of-way for Third Street vacated by Ordinance
No. 2477 that would upon vacation attach thereto by operation of law, lying Southwesterly of a
line described as follows:
Beginning at a point on the West line of Lot 12 in Block 4, National City No. 1, as per plat
recorded in Volume 2 of Plats, page 150, records of Jefferson County, Washington, that is 15
feet North of the Southwest corner of said Lot 12 as platted; thence Southeasterly to a point
within that portion of the right-of-way for Third Street vacated by Ordinance No. 2477 that is 12
feet South of the Southwest corner of Lot 13 in Block 4, National City No. 1, as aforesaid;
thence continuing in a Southeasterly direction to a point within that portion of the right-of-way
for Third Street vacated by Ordinance No. 2477 that is 20 feet South of the Southwest corner of
Lot 14 in Block d National City No. 1, as aforesaid; thence Conti,n ling in a Southeasterly
direction to a point that is 26 feet South of the Southeast corner of the Westerly 7.69 feet of Lot
15 in Block 4, National City No. 1, as aforesaid, said point being on the Southerly boundary of
the portion of the right-of-way for Third Street vacated by Ordinance No. 2477.
