The easement is subject to the following: 1. Grantee shall have the right at all times to enter the described Easement Area for the purpose of constructing,repairing, maintaining a footing for a wall. This is subject to the City giving 24 hours notice except in the case of an emergency. 2. Any costs associated with Grantee's activities shall be borne by the Grantee. 3. This Agreement shall be binding upon the Grantors and Grantee and their successors and assigns, and constitutes a covenant running with the land. 4. In connection with any Grantee's activities,the Grantee shall restore the property (Easement Area and any immediately adjacent area)to the condition it was in prior to the activity. 5. Grantee will release and terminate this Easement if Grantor, or successors and assigns, redevelops the property in a manner that removes the need for the wall and footing that is the subject of this Easement.
