EASEMENT
The Grantor(s), Jill and John Buhler, husband and wife, for and in consideration of
the sum of TEN and NO/100---($10.00)---Dollars, and other valuable considerations,receipt
and sufficiency of which is acknowledged,hereby convey(s) and grant(s) unto the City of
Port Townsend, a Washington municipal corporation and its assigns, an easement under the
hereinafter described lands for the purpose of constructing,repairing,and maintaining a
footing for a wall, as depicted on the attached diagram called"Wall Section."
Said lands being situated in Jefferson County, State of Washington, and described as
follows:
Description of Easement Area:
A strip 8" in width, commencing at the northeast corner of the property, and extending
generally southerly along the easterly property line a distance of approximately 102', as
depicted on the attached map called"easement area."

Description of Property Subject to the Above Easement:
Lots 2 and 4,Port Townsend Old Townsite, Records of Jefferson County, Washington.
The easement is subject to the following:
1. Grantee shall have the right at all times to enter the described Easement Area for the
purpose of constructing,repairing, maintaining a footing for a wall. This is subject to the
City giving 24 hours notice except in the case of an emergency.
2. Any costs associated with Grantee's activities shall be borne by the Grantee.
3. This Agreement shall be binding upon the Grantors and Grantee and their successors
and assigns, and constitutes a covenant running with the land.
4. In connection with any Grantee's activities,the Grantee shall restore the property
(Easement Area and any immediately adjacent area)to the condition it was in prior to the
activity.
5. Grantee will release and terminate this Easement if Grantor, or successors and assigns,
redevelops the property in a manner that removes the need for the wall and footing that is the
subject of this Easement.
