These parties share a common wall between multi -story buildings located in downtown Port Townsend, Jefferson County, Washington. High Divide needs to secure a building permit from the City of Port Townsend for development of its property, and the City is requiring a fire and safety easement into Palace's building. There is mutual benefit to the parties to have an additional means of egress for fire and safety purposes. In the event the City of Port Townsend issues a building permit to High Divide under File No. PRE05 -022, and in consideration of that event, Palace and High Divide hereby agrees as follows: FIRE & SAFETY EASEMENT Page 1 of 3 511309 Page: 2 of 3 05/18/2006 01:01P Jefferson County Aud HIGH DIVIDE LLC EASE 34.00 1. Palace hereby grants to High Divide a perpetual easement through it's North wall on the third floor for egress for fire and safety purposes. 2. This easement is appurtenant to the properties described below and includes the right to construct, repair and maintain a fire door as required by the City of Port Townsend. 3. This easement is limited to egress for fire and safety purposes only and the fire door shall be alarmed and signed to prohibit other forms of egress. Palace's property is legally described as: Lots 1, 2 and 4, except the Townsite of Port Townsend, Page 1, records of Jefferso n Tideland District No. 95. North 12 feet of Lot 4, Block as per plat recorded in Volume County, Washington. Said Lo t High Divide's property is legally described as: 39, Original 1 of Plats, 1 includes The East Y2 of Lot 3, Block 39, Original Townsite of Port Townsend, as per plat recorded in Volume 1 of Plats, Page 1, records of Jefferson County, Washington, including the Easterly Y2 of width of Tidelands District No. 96, Tidelands of the First Class in front of the City of Port Townsend.
