EASEMENT LOCATION: Except as may be otherwise set forth herein, Grantee's rights shall be exercised upon that portion of the Property (the "Easement Area" herein) that is ten (10) feet in width having five (5) feet of such width on each side of the centerline of Grantee's systems located as constructed or to be constructed, extended or relocated on the Property, except those portions of the Property occupied by existing building footings, foundations, and /or subsurface structures. 1. Purpose. Grantee shall have the right to use the Easement Area to construct, operate, maintain, repair, replace, improve, remove, and enlarge one or more utility systems for purposes of transmission, distribution and sale of gas and electricity. Together with the right of access over and across said Property to enable Grantee to exercise its rights hereunder. Grantor's Use of Easement Area. Grantor agrees not to erect any structures on said Easement Area, and further agrees not to place trees, rockeries, fences or other obstructions on the Property that would interfere with the exercise of Grantee's rights herein. Developer agrees to maintain a minimum of five feet of clearance between the electrical facilities and buildings or other improvements on Developer's property as required by PSE's Standards. If it is determined by PSE that a recordable easement on Developer's property or other property is necessary, it shall be the Developer's responsibility to obtain such easements in a form acceptable to PSE. As a condition of receiving electrical service for your project, when you provide the excavation for PSE's electrical facilities, outlined below are some of the requirements and conditions associated with your excavation work. If you need additional information, please call the PSE contact person listed below. EXCAVATION REQUIREMENTS 1. Developer is responsible for acquiring utility locates by calling One -Call, 1- 800 - 424 -5555 (except in Kitsap Co. which is 1- 800 - 553 -4344) at least 48 hours (two full working week days) prior to digging. The excavation must meet the requirements of the Washington Administrative Code and Safety Standards. 2. Developer shall call the PSE contact person noted below for trench and route approval prior to starting excavation. 3. Developer is responsible for any damages caused to utilities by improper back -fill and compaction. The electrical primary trench must be between 36" and 48" deep. The electrical service trench shall be 24" deep. All trenching and back -fill must be free of sharp objects and construction debris. If required, Developer shall provide sand bedding and cover material on site as instructed by PSE's Contact Person. A 12" lateral separation is required between PSE electrical facilities and other utilities. 4. There must be a 12' wide unobstructed area beside the trench to provide access for equipment and materials. 5. The vault excavation dimensions are noted on the attached work sketch. Vault holes must have a solid level bottom with a minimum 6" crushed (5/8 minus) rock bedding. 6. Developer shall provide the excavation for PSE electrical facilities within the designed location. Developer shall provide final grade and staking of property lines prior to installation of PSE's electrical facilities. 7. Developer will be financially responsible for the relocation of PSE's electrical facilities and /or any damages resulting from dig4ns due to changes or variations in grade that are made after the installation of PSE's electrical facilities. FINAL GRADE CERTIFICATION By my signing below, I certify that the electrical facilities work area shall be at final grade prior to excavation. I assume full responsibility for my excavation work and the resulting location of these facilities. Also, 1 agree to indemnify, defend and hold harmless Puget Sound Energy from all liability arising out of, or in connection with my work, including but not limited to all claims, losses, damages, and expenses, including reasonable attorney's fees, which result from my failure to excavate within easement areas or rights -of -way, or from digging without adequate rights on adjoining properties.
