Tennesen GRANTEE: City of Port Townsend, a Washington municipal corporation JEFFERSON COUNTY ASSESSOR'S TAX PARCEL NO. 966- 600 -307 FOR AND IN CONSIDERATION OF One Dollar ($1.00) and other good and valuable consideration, the receipt of which is hereby acknowledged, Terry Tennesen and Tamera L. Tennesen, husband and wife, ( "Grantors "), hereby convey and warrant, in perpetuity, to Grantee, the City of Port Townsend, a Washington Municipal corporation, its successors and assigns, a perpetual, non - exclusive easement over, through, under and across the following described property situated in Jefferson County, Washington: Legal Description of Property: Lots 15 and 16, Block 3, Laurel Shade Addition to the City of Port Townsend, as per Plat recorded in Volume 1 of Plats, Page 45, Records of Jefferson County, Washington. Legal Description of Easement: North ten (10) feet of Lot 15 of the above - described property. This Underground Utility Easement is for the purpose of granting the City of Port Townsend underground utility easement rights over, through, under and across the described property in perpetuity for waterlines. SUBJECT TO THE FOLLOWING: I . Grantee shall have the right at all times to enter the described property for the purpose of inspections and maintaining the property, including but not limited to inspecting, maintaining, 482435 Paso: 2 of 4 03/24/2004 12:31P Jefferson County, WA CITY OF PORT TOWNSEN EASE 22.00 improving, repairing, constructing, reconstructing, locating, and relocating any utility lines. This is subject to item 2 below, and to the City giving 24 hours notice except in the case of an emergency. 2. Any costs associated with inspection, maintenance, improvement, repair, construction, reconstruction, and improvements upon the property undertaken by the Grantee shall be borne by the Grantee. 3. This Agreement shall be binding upon the Grantors and Grantee and their successors and assigns, and constitutes a covenant running with the land. 4. Structures and /or permanent storage within the above - described Easement area are prohibited. 5. Grantee shall restore the property to as good a condition as the property was in prior to any work on the easement. Grantee shall replace the existing lawn. Grantor shall be responsible to remove and relocate any structures (including, existing garden area and enclosure) in the easement. Grantee shall set aside for Grantor any topsoil from garden area. Grantee shall be responsible to replace any plants or trees damaged or removed in the process of using this easement. These replacements will be paid for within no more than one week from the time work is performed. All wood from trees that are cut from the property as part of working within this Easement will be given to the Grantors without charge. If Grantee fails to perform work or pay for damages within timelines specified, Grantor reserves the right to pay work and /or replacements and to bill the City, such bill to be paid in full within 30 days upon receipt.
