EASEMENT and AGREEMENT
for
PARKING
For and in consideration of One dollar [$1.00] and other valuable consideration, the
receipt of which is hereby acknowledged, RoseWind, a Washington nonprofit mutual
corporation, Grantor herein, grants,conveys,and warrants to Della Walker, (Grantee herein), for
the purposes hereinafter set forth, a perpetual easement across and over the following described
real property, (the Property herein), located in Jefferson County, Washington:
Common Areas of RoseWind Planned Unit Development, as per plat
recorded in Volume 6 of Plats,pages 234 and 235, and amendments thereto, records
of Jefferson County,Washington,more particularly described as Parcel 27.
Situated in the County of Jefferson, State of Washington.
Except as may be otherwise set forth herein, Grantee's rights shall be exercised upon
that portion of the Property deemed the Right-of-Way herein, more particularly described as:
A portion of Parcel #27, at the southwest corner of Parcel #27,abutting the east boundary
of the Fire Lane Access to Lots #18 & 19 and the south boundary of Parcel 27, measuring 20'
(twenty-feet)along the east and west sides and 20' (twenty-feet) along the north and south sides,
for the benefit of the owners of Parcel #19, their successors and assigns, for the following uses
and purposes:

1. Purpose.A parking area for the benefit of the owners of Parcel#19,their successors and
assigns.
2. Access. Grantee shall have the right of access to the Right-of-Way, over and across the
Property,to enable Grantee to exercise its rights hereunder.
3. Grantor's Use of Right-of-Way. Grantor reserves the right to use the Right-of -Way
for any purpose not inconsistent with the rights herein granted, provided: that Grantor shall not
construct or maintain any building or other structure, or conduct any other activity on the Right-
of-Way, which would interfere with the exercise of the rights herein granted.
4. Term of Easement. The rights herein granted shall continue in perpetuity and shall run
with, and encumber perpetually, the Property affected, and shall be appurtenant to the property
owned by the grantee, herein,more particularly described as:
Parcel 19, of RoseWind Planned Unit Development, as per plat recorded in Volume
6 of Plats, pages 234 and 235, and amendments thereto, records of Jefferson
County,Washington. Situated in the County of Jefferson, State of Washington.
5. Indemnity. By accepting and recording this easement,Grantee agrees to indemnify,hold
harmless, and defend Grantor from and against any and all claims for injuries and/or damages
suffered by any person which may be caused by the Grantee's exercise of the rights herein
granted; provided, that Grantee shall not be responsible to Grantor for any injuries and/or
damages, to any person,caused by acts or omissions of Grantor.
6. Agents, Employees, Successors and Assigns. The rights and obligations of the parties
shall inure to the benefit of and be binding upon their respective agents, employees, successors
and assigns.
