The City Council of the City of Port Townsen , Washington resolves as follows:

WHEREAS, the original preliminary UD and BSP applications, together with application for
Multi-Family Design Review, were submitted n or about February 17, 2004 (LUP04-016) and
involved construction of a 120-unit, three-slOr , wood framed building of approximately 113,000
square feet within the R-III and R-IV zoning di tricts. The five (5) original subject properties, together
with .9 acre of internal right-of-way that woul be vacated, total approximately 4. 86-acres. Through
the BSP process, the underlying subject prope ies would be replatted, the existing lots and internal
rights-of-way vacated, and two new lots would be created. Lot I of the BSP is 4.09 acres in size and
contains the Senior Housing building. Lot 2 is .78 acres in size and contains heavily forested land the
applicant proposes to dedicate to the City as pa sive open space as partial fulfillment of the PUD
approval criteria; and I

WHEREAS, the Mountain West PUD! BSP and Multi-Family Design Review applications
were granted preliminary approval, subject to iertain conditions, by the City's Hearing Examiner on
May 17, 2004; and
WHEREAS, the Development serViceeepartment has found that, with the exception of some
required landscaping, the final PUD and BSP quest is in conformance with the Hearing Examiner's
preliminary PUD decision, complies with appl" cable environmental mitigation measures, and includes
appropriate measures for recording to title a PI ed Unit Development Agreement (PUDA) signed by
both the applicant and the city. So long as an tppropriate financial security is established for the
remaining landscaping, final PUD and BSP ap*roval Seaport Landing is consistent with Chapters
17.32,18.16 and 18.24 of the PTMC; and I
WHEREAS, the Development servic1 Department has identified an appropriate financial
security for landscaping improvements yet to , completed; and
WHEREAS, the City Council has rev.ewed the proposal and concurs with the Development
Services Department's determination that the f nal PUD and BSP request is in conformance with the
Hearing Examiner's preliminary PUD decisio ; and
WHEREAS, on October 3, 2005, the ity Council referred to the Park and Recreation
Advisory Board for recommendation on wheth r the City should accept the proposed dedication of .78
acres for park purposes, and the Board reco ended in favor of accepting the parcel and that it be
used as a passive park; and

WHEREAS, the Public Works DireclO recommends that there be no restriction placed on
potential future uses of the park, to allow for fl xibility in future planning. For example, the park (or
some portion of it) might be developed with so e playground equipment or other low impact amenities
following planning involving the neighborhood and Park and Recreation Advisory Board, and
consistent with the Examiner's approval; I

NOW, THEREFORE, BE IT RESO VED, that the City Council hereby APPROVES the
Seaport Landing Planned Unit Development an the dedication of Lot 2 as passive park space to be
included in the City's park system, subject to following:
1. Council directs staff to facilitate record. g of the final Binding Site Plan with the County
Auditor once an appropriate financial s curity for landscaping has been established.
2. The City Manager is hereby authorized to sign the required PUD Agreement on behalf of the
City after it has been reviewed and app oved by the Directors of Public Works and
Development Services in consultation ith the City Attorney.
3. Council accepts the proposed dedicatio of approximately .78 acres for park purposes, without
restriction as to future use or developm nt as determined by the City so long as said use or
development is consistent with the Exa iner's decision.
