DECLARATION OF EASEMENT AND COMMON DOORWAY AGREEMENT ST This Declaration is executed this I day of November, 2005, by VICKI S. DOHRMAN, a single woman, as Grantor, for the purpose of creating an easement and covenant on property described herein. WHEREAS, Grantor owns real property in the City of Port Townsend, Jefferson County, Washington, legally described as follows: The Southeasterly 90 feet of Lot 5 and the Northeasterly 4 feet 2 1 111111111 Hill 11111111 5 @4891 Page: 2 of 4 Jefferson County, A HISTORIC SUITES LLC MULTI/67 0010'13A inches of the Southeasterly 90 feet of Lot 7, Block 57, of the Original Townsite of Port Townsend, as per plat recorded in Volume 1 of Plats, page 1, records of Jefferson County, Washington, except that portion, if any, lying within the Northeasterly 20 feet of said Lots 5 and 7; all situated in the County of Jefferson, State of Washington. hereinafter referred to as "the Property". WHEREAS, Grantor is, contemporaneously herewith, filing a Condominium Declaration covering all of the aforesaid Property and the existing improvements thereon, creating the"Fountain Condominiums,"which will consist of three commercial and three residential condominium units; and WHEREAS, the improvements now on the Property consist of two separate two- story buildings, which will be joined together in the Condominium Declaration; and WHEREAS access to all of the units in the condominium (except Unit 3) will be through a common doorway located on the Washington Street side of Building 1, which leads to an entry alcove that provides entry to doorways for Units 1 and 2 on the ground floor of building 1, and which also leads to a stairway which goes upward to a hallway on the second floor of Building 1, which provides access to residential Units 4 and 5. The hallway continues through Building 1, leading to a deck on the rear of both buildings, which then provides access to Unit No. 6 on the second floor of Building No. 2. The location and configuration of the door, entry alcove, stairway, hallway and deck are all shown on the Survey Map and Plans which are recorded under Jefferson County Auditor's File No. 50+16(1 D ; and WHEREAS Grantor wishes to create an easement and a covenant regarding the creation, use and maintenance of the common doorway, entry alcove, stairs, hallway and deck; and WHEREAS, the City of Port Townsend has indicated that it will not approve the creation of the Fountain Condominiums or issue and necessary building permits for the project without this Declaration being executed and recorded. NOW, THEREFORE, for and in consideration of the creation of the condominium and the mutual covenants contained below, Grantor hereby agrees as follows: 1. Easement. Grantor hereby grants a permanent easement and license to all future owners of the condominium Units on the Property, and to their guests and invitees, over and through the common doorway, the entry alcove, the stairs, the hallway and the deck, as indicated in the Survey Map and Plans, for the purpose of ingress and egress to and from the separate entrances to each of the condominium units. 2 504891 Page: 3 of 4 11/02/2005 10:13A Jefferson County, WA HISTORIC SUITES LLC MULTI 67.00 2. Common Doorway. The common doorway shall be constructed in accordance with all applicable rules and regulations and in accordance with the necessary permits and approvals required by the City of Port Townsend. The opening shall be maintained in accordance with all applicable requirements of the Port Townsend Building Code. The doorway shall be through the wall on the Washington Street side of Building 1, at the point indicated on the Survey Map and Plans. 3. Single Building. Grantor, for herself and for all future owners of condominium units on the Property, hereby agrees and covenants that the two buildings which comprise the condominium, and the six separate condominium units contained therein, shall hereafter be considered to be separate portions of a single building for the purpose of compliance with the Port Townsend Building Code. 4. Binding Effect. This Declaration shall be deemed a covenant running with the land and with all the condominium units created by the Declaration filed herewith, and shall be binding upon and inure to the benefit of all future owners of the Property and the condominium units. This Declaration shall not be revocable unless the Condominium Declaration is terminated in the manner required by law and the Property is restored to single ownership.
