GRANTOR: Mount Baker Block Corp., a Washington corporation
GRANTEE: Rose, Incorporated, a Washington corporation
FOR AND IN CONSIDERATION OF mutual benefits, Mount Baker Block Corp., a Washington
corporation, ("Grantor") hereby conveys and warrants, in perpetuity, to Rose Incorporated, a Washington
corporation, ("Grantee), and its successors, and assigns, a perpetual, non-exclusive easement over,
through, and across the following described property situated in Jefferson County, Washington, subject to
and together with the Purpose and Terms of Easement set forth in this instrument:
Legal Description of Property Subject to Easement
All of Lot 1, the south 22.5 feet of Lot 2, the East 1/2 of Lot 3, and the South 22.5 feet of the
East 1/2 of Lot 4, all in Block 40, of the Original Townsite of the City of Port Townsend, as
per Plat recorded in Volume 1 of Plats, page 1, records of Jefferson County, Washington

Purpose and Terms of Easement.
UTILITY EASEMENT—Page 1
This Utility Easement is for the purpose of granting the Grantee a utility easement for the location
of electrical lines and related equipment over, through, and across the described property in perpetuity for
the benefit of Grantee's property shown on Exhibit A(T.P.N. 989-704-002).
THE EASEMENT IS SUBJECT TO THE FOLLOWING:
1. Grantee shall have the right at all times to enter the described Easement Area for the purpose of
making allowed utility improvements, inspections and maintaining utility allowed improvements,
including but not limited to, inspecting, maintaining, improving, repairing, constructing, reconstructing,
locating and relocating allowed utility lines. This is subject to paragraph 2 below, and to the Grantee
giving 5 days notice except in the case of an emergency.
2. Any costs associated with inspection, maintenance, improvement, repair, construction,
reconstruction, and improvements upon the property undertaken by the Grantee shall be borne by the
Grantee.
3. This Agreement shall be binding upon the Grantors and their successors and assigns, and binding
on (and benefit) the Grantee and its successor and assigns, and constitutes a covenant running with the
land.
4. Structures that interfere with the easement are prohibited.
5. Grantor reserves the right to relocate the utility easement so long as its function and purpose are
maintained. Any relocation of Grantee's improvements shall be done at Grantor's expense.
