RESOLUTION NO. 12-024
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF PORT TOWNSEND FIXING THE TIME FOR A PUBLIC HEARING
ON STREET VACATIONS IN BOAT HAVEN, AND TRANSFER OF CITY DOCK,
UNION WHARF AND ABANDONED RAILROAD LINE IN BOAT HAVEN TO PORT,
SUBJECT TO CONDITIONS
BE IT RESOLVED, THAT:
The Port Townsend City Council shall conduct a public hearing on the following matters
in connection with A Joint Resolution of the City Council of the City of Port Townsend,
Washington and the Commission of the Port of Port Townsend (City Resolution No. 12-022 and
Port Resolution No. 575-12, May 21, 2012). The Resolution provides for a tentative settlement
agreement of matters of mutual concern to the City and the Port, including, on closing, the
transfer of the Port's interest in property in the vicinity of Kali Tai Lagoon to the City. If
approved by the City Council following the hearing, the following actions could occur:
1. Vacation of(termination of City interest in) certain rights of way in Boat Haven(property
zoned M-II(A) Marine Related Uses), including portions of Jefferson Street, San Juan Avenue,
10th Street, 8th Street, Landes Street and Hill Street, and the alley between Landes and Hill,
subject to maintenance of traffic circulation through the Boat Haven consistent with the
conditions specified in Street Vacation Ordinance No. 2487 (1995); dedication of sufficient
right-of-way at the Haines Place entrance to the Boat Haven to enable the City to control all four
corners of the intersection(i.e., to enhance opportunities for grant-funded intersection
improvements);
2. Transfer of the entire City ownership interest in City Dock (excluding the Pope Marine
Building) and Union Wharf to the Port, subject to continued free pedestrian public access to the
structures,provided that allowed commercial uses of the docks will not be precluded; and proper
maintenance of the docks; and
3. Transfer of the City ownership in the entirety of its abandoned railroad right-of-way and
associated tidelands property not in use as part of the Larry Scott Trail (i.e.,portions of Tax 34,
APN 001104011, a vacated portion of Jefferson Street within the Boat Haven, and the old
railroad"Y" south of the Boat Haven) to the Port. The existing Larry Scott trail is not affected
The street vacations and transfers would only become effective upon closing of the transfer of
the Port's Kah Tai property to the City, and other conditions. The hearing would be conducted

in conjunction with other matters that are part of the tentative settlement agreement, including,
nonconforming use code changes, Boat Haven stormwater fees, and repeal of City fee ordinance
for City Dock and Union Wharf.
The hearing will be conducted at or about 6:30 PM on Monday, July 16, 2012, in the Council
Chambers of City Hall, 540 Water Street, Port Townsend, Washington, or such other date as the
Mayor determines is necessary to accommodate other Council business, so long as the hearing is
not more than 60 days from adoption of the Resolution. All interested parties may appear at the
hearing and provide oral or written testimony. Anyone wishing to submit written comments may
also do so up to 4 PM of the date of the hearing by submitting them to the City Cleric

ADOPTED by the City Council of the City of Port Townsend at a regular business
meeting thereof, held this 18`h of June 2012.
