RESOLUTION NO. 12-021
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PORT TOWNSEND,
WASHINGTON AUTHORIZING THE CITY MANAGER TO SIGN A NEW
BIOSOLIDS COMPOSTING FACILITY LAND-USE AGREEMENT WITH
JEFFERSON COUNTY FOR USE OF THE BIOSOLIDS COMPOSTING FACILITY
SITE
WHEREAS, the City Waste Water Utility operates the Biosolids Composting Facility to
compost biosolids from the City's waste water treatment plant, septage from septic systems
located in the City and the County, and yard waste from City and County residents; and
WHEREAS, the facility was constructed in 1993 on land owned by the County adjacent
to the County's Solid Waste Transfer Station and Recycling Facility in accordance with an
interlocal agreement between the County and the City for the operation of the facility; and
WHEREAS, the original land-use interlocal agreement expires on 5 January 2013 and in
2011 the County notified the City that it wished to update the agreement and gave notice to the
City that the current agreement would not be automatically renewed; and
WHEREAS, the City and County Public Works staffs have met to draft an update to the
agreement that will run for a 20-year term with the City holding an option for an additional 20-
year term; and
WHEREAS, the proposed agreement reflects the mutual benefits to City and County
residents provided by the operation of the Biosolids Facility.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Port
Townsend as follows: That the City Manager is hereby authorized to enter into a new Biosolids
Composting Facility land-use license agreement with Jefferson County in accordance with the
terms as outlined in the draft agreement developed by City and County staff.
ADOPTED by the City Council of the City of Port Townsend at a regular meeting
thereof, held this 7th day of May 2012. j
