Box 4W53 Olympia, WA 98504-0953 RE: CASE NLIMBER g6rl2402g Dear Mr. Neilson and Board Members: The Port of Fort Townsend and the City of Port Townsend have reached the following agreement which resolves all of the concerns the Port had regarding the Comprehensive plan adopted by the City. Issue Nio. l: Land Use Designation A. Kai-Tai Lagoon - Port-Ouvned Progerty Leased to thq City within the General Kai-Tai Lasoon Area - The Port will provide the City with a map of the Kai-Tai area which shows Port-Ovned properties within the Kai-Tai Lagoon area. The City staffwould then, through hash-marks or some other designation, clearly delineate the Port-Owned property within the Kai-Tai I-agoon area. The City staff would further recommend for adoption by the Council a resolution which, in substance, would state iN follows: Designated properties are owned by the Port of Port Townsend and leased to the City of Port Townsend for use as a public park. At such time as the lease from the Port !o the City terminates for any reason, the Port shall be free to apply for whatever land use designation which would be consistent with the Port's proposed use of the properry at that time. Upon such application by the Port, the City shall review the land use and the designation as *P/OS Existing Park or Open Space" shall not be controlling. GROWfiI MANAGEMENT IIEARINGS BOARD Page 1a B. Fort Worden Beach - The'Port will provide the City with the legal description of the Port-Owned property at Fort Worden beach, and the City will clearly designate that property on the land use map as Port-owned property: Issue No. 2: Port Townsend Boat ltraven Ileight Restriction It is the Poft's understanding that the City staff takes the position that the chart showing the 35 foot height restriction was simply a carqr-over from previous restrictions imposed by zoning. It is further the Port's understanding that the.City staff recognizes that planned uses within the Boat l{aven will in all likelihood require construction of buildings higher than the 35 foot zoning restriction. It is the Port's understanding that City staff will consider the requirements of the Port for building heights of at least 50 feet in enacting the zoning ordinances for that area, and that the Port's position will be considered by the Planning Commission prior to enactment of the zoning ordinances in April 1997. Issue No. 3: New llay Fisheries and M - IIA It's the Port's understanding that the City staff acknowledges that it was never the intention to exclude New Day Fisheries and its fish processing operation from the M - IIA Land Use Designation. It is further the Port's understanding that City staff, at the time of enacting of the zoning ordinances, will recommend that fish processing be an included use within the M - IIA designation. Issue No. 4: Water and Claltam Streets The City staffhas agreed to amend the Land Use map to reflect that vacated Water Street at the Boat Haven and vacated Clallam Street at Point Hudson are in fact vacated. and acknowledge that this was an omiision in the mapping process. Issue No. 5: Quincy Street Ilock It is the Port's understanding that the City acknowledges that the right-of-way for the east half of Quincy Street north of the Quincy Sfeet Dock is not "P/OS Existing Park and Open Space." It is the Port's understanding that the City acknowledges that the designation as it is shown on the Land Use map w:ui a result of a mapping convention which will be corrected in the next map. The City acknowledges that it was never intended to make the eastern one half of Quincy Street lying north of the Quincy Street Dock "P/OiS Existing Park and Open Space.'
