CITY aF" paRT TaWNSEND Port Townsend Planning Commission JUNE 1, 1979 HONORABLE MAYOR CITY COUNCILMEMBERS CITY OF PORT TOWNSEND AT THE REGULAR MAY 31, 1979 MEETING OF THE CITY PLANNING COMMISSION THE FOLLOWING REQUESTS WERE HEARD AND RECOMMENDATIONS MADE: APPLICATION NO: 7904-03 HOMER MOSS STREET VACATION 1232 19TH ST. PORT TOWNSEND STREET REQUESTED FOR VACATION, GRANT STREET BETWEEN 19TH AND 20TH STREETS. THE COMMISSION VOTED TO RECOMMEND TO THE COUNCIL APPROVAL OF THIS REQUEST AS IT COMPLIES WITH ITEMS 2 THRU 6 OF SECTION 5.20 OF ORDINANCE NO. 1802. APPLICATION NO. 7905-01 LYNARD ROBINSON VARIANCE 616 f\10LALLA AVE. OREGON CITY APPLICATION IS FOR A VARIANCE OF 3 FEET FROM THE SIDE OF THE HOUSE TO THE PROPERTY LINE.THE COMMISSION VOTED 4 TO 1 TO MAKE THE FOLLOWING RECOMMENDATION TO THE COUNCIL: THE COMMISSION FINDS THAT: THE PROPOSED VARIANCE WILLNOT AMOUNT TO A REZONE AND CONSTITUTE ANY CHANGE ON ANY BOUNDARY SHOWN ON THE OFFICIAL ZONING MAP; THAT SPECIAL CONDITIONS AND CIRCUMCTANCES EXIST WHICH ARE PECULIAR TO THE LAND; THAT THE SPECIAL CONDITIONS AND CIRCUMSTANCES ARE NOT A RESULT FROM THE ACTIONS OF THE APPLICANT; THAT GRANTING THE VARIANCE REQUEST WILL NOT CONFER A SPECIAL PRIVLEGE TO THIS PROPERTY THAT IS DENIED OTHER LANDS; THAT THE GRANTING OF THE VARIANCE WILL NOT BE DETERIMENTAL TO THE PUBLIC WELFARE; AND THAT THESE FINDINGS IN REGARD TO THE MINIMUM SETBACKS ARE REASONABLE AS FAR AS THE USE OF THE LAND; AND THAT THE FINDINGS ARE IN HARMONY WITH THE GENERAL PURPOSE AND INTENT OF THIS ORDINANCE NO. 1625; AS A FINDING OF FACT THAT THE INFORMATION IN THIS VARIANCE REQUEST IS THE MINIMUM VARIANCE THAT WILL MAKE POSSIBLE THE REASONABLE USE OF THIS LAND. WITH THESE FINDINGS THE COMMISSION RECOMMENDS TO THE CITY COUNCIL APPROVAL OF APPLICATION NO. 7905-01, A VARIANCE FROM SECTION 3.04 OF THE CITY ORDINANCE NO. 1625. ø. e . ADDITIONALLY THE GRANTING OF A VARIANCE UNDER THESE CONDITIONS MAKES IT DIFFICULT TO JUSTIFY NOT GRANTING VARIANCES UNDER SIMILAR CONDITIONS. THIS TENDS TO UNDERMINE THE AUTHORITY OF THE SETBACK REQUIREMENTS AS SETFORTH IN ORDINANCE NO. 1625. ALSO PRESENT WAS ROGER FRENCH CITY ENGINEER. MINUTES FROM THE APRIL 26, 1979 MEETING WERE READ AND APPROVED. CORRESPONDENCE: KAY WOJT WILSON SENT SOME INFORMATION TO THE COMMISSION FROM THE BREMERTON PLANNING DEPT. OLD BUSINESS: APPLICATION NO: 7903-03 SAM TAYLOR STREET VACATION AT THE APPLICANTS REQUEST THIS APPLICATION WAS NOT TAKEN FROM THE TABLE. NEW BUSINESS: APPLICATION NO. 7904-03 STREET VACATION STREET REQUESTED FOR VACATION, 20TH STREETS. MOTION BE MARSH/DUDLEY MOVE TO RECOMMEND TO THE CITY COUNCIL AS IT COMPLIES WITH ITEMS 2 THRU 6 OF NO. 1802. HOMER MOSS 1232 19TH ST.
