AT THE REGULAR APRIL 26, 1979 MEETING OF THE CITY PLANNING COMMISSION THE
FOLLOWING REQUESTS WERE HEARD AND RECOMMENDATIONS MADE:

REQUEST TO VACATE PEARY AVENUE FROM THE ALREADY VACATED CALUMET STREET THRU
THE ALREADY VACATED CLAREMONT STREET. THE COMMISSION VOTED TO RECOMMEND DENIAL
OF THIS REQUEST AS IT DOES NOT COMPLY WITH ITEMS 1,2,4 & 5 OF SECTION 5.20
OF ORDINANCE NUMBER 1802 AND FURTHER MOVE AS PART OF THE SAME MOTION THAT THE
P~NING COMMISSION FILE AN APPLICATION TO PROPOSE A VACATION OF 20 FEET ON
EACH SIDE OF THE PROPERTY EFFECTED BY APPLICATION NUMBER 7903-01.

THERE EXISTS EXTRAORDINARY CONDITIONS OR UNUSUAL CIRCUMSTANCES PECULIAR
TO THIS PROPERTY AND NOT THE RESULT OR THE ACTION OF THE APPLICANT.
THE LITERAL ENFORCEMENT OF THE REGULATIONS WOULD RESULT IN UNNECESSARY
AND UNDUE HARDSHIP.
JUSTICE COULD BE DONE AND THE PUBLIC INTEREST SECURED BY THE GRANTING
OF THIS SUITABLE VARIANCE.
THE PROPOSED VARIANCE IS IN COMPLIANCE WITH THE, PROVISIONS SET FORTH
IN SECTIONS 6.10A 1 THRU 8 OF CITY ORDINANCE NUMBER 1625, THE COMPREHENSIVE
ZONING ORDINANCE.
