PORT TOWNSEND REQUEST TO VACATE PEARY AVENUE FROM THE ALREADY VACATED CALUMET STREET THRU THE ALREADY VACATED CLAREMONT STREET. THE COMMISSION VOTED TO RECOMMEND DENIAL OF THIS REQUEST AS IT DOES NOT COMPLY WITH ITEMS 1,2,4 & 5 OF SECTION 5.20 OF ORDINANCE NUMBER 1802 AND FURTHER MOVE AS PART OF THE SAME MOTION THAT THE P~NING COMMISSION FILE AN APPLICATION TO PROPOSE A VACATION OF 20 FEET ON EACH SIDE OF THE PROPERTY EFFECTED BY APPLICATION NUMBER 7903-01. APPLICATION NO. 7904-01 ROBERT HINTON STREET VACATION 327 PST. PORT TOWNSENO REQUESTED VACATION, 15 FOOT STRIP VACATION OF BRYAN STREET BETWEEN MADISON AND CHESTNUT STREETS. THE COMMISSION VOTED TO RECOMMEND TO THE CITY COUNCIL APPROVAL OF THIS REQUEST AS IT COMPLIES WITH ITEMS 2 THRU 6 OF SECTION 5.20 OF ORDINANCE NUMBER 1802 AND NO DEPARTMENT HEADS OBJECTED. APPLICATION NO. 7904-02 HOWARD HILL 340 26TH PORT TOWNSEND FROM THE HOUSE TO LOT PROPERTY LINE. THE COMMISSION REQUEST FOR A REAR VARIANCE FINDS THAT: THE VARIANCE REQUEST IS DN COMPLIANCE WITH THE GOALS AND PO[ICIES OF THE COMPREHENSIVE PLAN AND SOUND PLANNING PRINCIPLES. THERE EXISTS EXTRAORDINARY CONDITIONS OR UNUSUAL CIRCUMSTANCES PECULIAR TO THIS PROPERTY AND NOT THE RESULT OR THE ACTION OF THE APPLICANT. THE LITERAL ENFORCEMENT OF THE REGULATIONS WOULD RESULT IN UNNECESSARY AND UNDUE HARDSHIP. JUSTICE COULD BE DONE AND THE PUBLIC INTEREST SECURED BY THE GRANTING OF THIS SUITABLE VARIANCE. THE PROPOSED VARIANCE IS IN COMPLIANCE WITH THE, PROVISIONS SET FORTH IN SECTIONS 6.10A 1 THRU 8 OF CITY ORDINANCE NUMBER 1625, THE COMPREHENSIVE ZONING ORDINANCE. ALSO PRESENT ROGER FRENCH, CITY ENGINEER AND DAVID GOLDSMITH COUNTY PLANNER. MINUT6S FROM THE MARCH 29, 1979 MEETING WERE READ AND APPROVED. OLD BUSINESS: APPLICATION NO. 7903-01 STREET VACATION FRANK HILLIER 2860 PEARY AVE PORT TOWNSEND REQUEST BE TAKEN FROM THE TABLE. MOTION BE MARSH/DUDLEY THAT THIS VOTE 4/YES O/NO HENDERSON EXCUSED HIMSELF FROM, TAKING PART IN THIS REQUEST.
