RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PORT
TOWNSEND GRANTING FINAL PLAT APPROVAL FOR PHASE II OF
HAMIL TON HEIGHTS PLANNED UNIT DEVELOPMENT
WHEREAS, Hamilton Heights, LLC has petitioned the City for final approval
of a Full Subdivision (Plat) and Planned Unit Development (PUD) covering Phase II of
the residential development known as Hamilton Heights. Hamilton Heights is located
south of Hastings A venue, west of Howard Street and north of 20th Street; and
WHEREAS, the original preliminary Plat and PUD application was submitted
in September1994 (File No. 9409-05) and was granted preliminary approval, subject to
certain conditions, by the City Council in October 1995. The original request involves
construction of a 101 unit manufactured home subdivision dispersed across 25.13
acres; and
WHEREAS, Phase II of Hamilton Heights involves the creation of 38 new lots,
served by paved interior roadways, pedestrian sidewalks and pathways, engineered
stormwater facilities and public water and sewer. One lot within Phase II is reserved
for development as a tot lot containing benches and picnic tables; and
WHEREAS, the required improvements are currently under construction and
the developer wishes to establish a financial security to cover the remaining costs of
installation; and
WHEREAS, Port Townsend Municipal Code (PTMC) section 18.16.100.D
allows that a final plat may be approved provided the improvements are guaranteed by
a subdivision bond or cash escrow in the amount of 120% of the estimated costs for the
City to contract for construction of the requirement improvements; and
WHEREAS, the Public Works Director has reviewed and approved the
construction plans for all required infrastructure and will accept a financial security for
those improvements not yet completed. Estimates for any remaining work will be
reviewed by City staff to use as a basis for determining the financial security amount.
With such measures in place, the final Plat and PUD request will be in compliance with
the infrastructure improvements as required in the PUD Agreement; and
WHEREAS, the Building and Community Development (BCD) Director has
found that, with the exception of some required landscaping, fencing and tot lot
improvements, the final Plat and PUD request is in conformance with the PUD
Agreement and complies with applicable environmental mitigation measures. So long
as an appropriate financial security is similarly established for these remaining
improvements, final Plat and PUD approval for Phase II of Hamilton Heights is
consistent with Chapters 17.32 and 18.16 of the PTMC; and
WHEREAS, the City Council has reviewed the proposal and concurs with the
Building and Community Development Director's determination;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Port Townsend that fmal plat approval of Phase II of the Hamilton Heights PUD is
hereby APPROVED, and staff is directed to facilitate recording of the final Plat with
the County Auditor, subject to the posting of the required financial security for the
remaining improvements.
ADOPTED by the City Council of the City of Port Townsend at a regular
meeting thereof, held this seventeenth day of May 2004.
