ROLL CALL The meeting was called to order at 7:00 PM by Chair Lois Sherwood. Other members in attendance were Lisa Enarson, Karen Erickson, Cindy Thayer and Mark Welch. Bob Rickard was excused. Ernie Baird entered the meeting at 7:03 PM. Staff members present were Ian Zimmer and Sheila Spears. Council Mem~er Davidson was' also in attendance. II. APPROV AL OF MINUTES Motion to approve the minutes of June 16, 1994, was made by Erickson and seconded by Thayer. All were in favor. III. _ COMMUNICATIONS Usa Enarson said that the Planning Commission is grieved tonight at the loss -ºf City -P1anner~ Darlene Bloomfield, that it won't be the same without her. Enarson spoke about our loss, saying "Jan Zimmer is here tonight, presenting the matter before us, and I was asked to just make a few words, and as I was reading through the business of tonight's meeting I was looking at Darlene's signature and knowing that whoever the applicant was in this case that she would have been honest, forthright, accommodating, always helpful, always calm, and al-ways dignified. And on a personal note, I was pleased to have had the - opportunity to go to the memorial service for Darlene and to get some grasp of how beloved she was as a. person in her community, the small town that she came from. She was a tremendous person at only age 30 to be lost, and I hope that any city planners reading _ this in the future will know what a lovely, gracious person she was and how much we will miss her. II Enarson also gave information about a memorial education fund which has been set up for Darlene's nieces and nephews at the U.S. Bank ~t the Quilcene branch. Thayer seconded Enarson's comments and said that we really are going to miss her. Lois Sherwood read the City Council Resolution memorializing Darlene. Jan Zimmer mentioned that city staff is working on replacing the bench that has disappeared from in front of City Hall, in memory of Darlene. · · · Planning Commission Minutes July 28, 1994 Page Two IV. OLD BUSINESS A. Robert A. Friedman, Rose Theatre Expansion (Conditional Use Permit Application #9406-04) 1. Staff Report (Jan Zimmer) Thayer apologized to the applicant for the delay because of a lack of a quorum for the hearing originally scheduled for 7/14/94. Welch excused himself from the proceedings because he owns property adjacent to the proposal. Zimmer read the draft Findings of Fact and Conclusions for the proposal to construct a 175 sq. ft., two-story addition to an existing 1,000 sq. ft. photography studio to be used as an 86- seat movie theatre. The proposal would add an additional movie screen to the existing Rose Theatre located at 235 Taylor Street. 2. Public Testimony Robert A. Friedman, proponent, stated that he didn't have any other information to add to the draft report because Darlene was so thorough and such a pleasure to work with. He said he was impressed with the draft when it was handed to him. Peter Simpson, 1150 57th Street, spoke in favor of the proposal, saying that The Rose gave him a reason to come back downtown at night. No one spoke in opposition to the proposal. 3. Committee Report (Welch/Thayer) Thayer asked a question about Exhibit 4, saying that it appears that the new addition to the theatre is going into the street right-of-way. Friedman explained that the portion of the addition mentioned will be elevated and is over property owned by Sam Kyle who owns the Baker Block building. Friedman said an agreement is being worked on with Kyle to secure the rights to the elevated space. It will be dealt with in the building permit process. He said this addition will probably be a very minor thing compared to the recycling platform which is already well into the city's right-of-way. · · · .' Planning Commission Minutes July 28, 1994 Page Three Thayer asked what happens at the end of the two-year trial period (parking) mentioned on the application. Zimmer said that the trial period has expired and the City has not received any complaints about parking and matinees. Thayer stated she has no objections to anything else in the draft report. Zimmer made a correction on the parking calculations. Erickson said the Planning Commission is supposed to make sure the proposal meets the code for setbacks. The code allows for zero setbacks in the commercial district but doesn't address going over the property line. She said she wants the City Council to know that was questioned but that it doesn't need to be a condition. Planning Commission discussed solutions to the intrusion into the neighboring property, e.g., easement, variance, condition. Sherwood asked how big of a problem it would be if this wasn't cleared up before time of building permit review. Friedman said it would be a major problem because the area in question is an exit. Baird asked that the City Attorney be involved because it is not clear that this proposal conforms to the code. He said usually in this kind of a case we would ask for a clarification and take it up at a later meeting. Zimmer suggested that because of a lack of staff, including a City Attorney, the proof of whether or not the building extends into neighboring property or city right-of-way could be taken care of at the time of building permit plan review. The proponent would have to produce an easement or something from the property owner to allow this construction to take place. Zimmer said that a condition could be added which stipulates that the proposed addition shall comply with applicable laws, building codes and zoning regulations including but not limited to setbacks, height restrictions and lot coverage. Sherwood said that she has confidence that it can be worked out to everybody's satisfaction. Baird said he wanted documentation that an agreement with Kyle had been reached. Friedman said that he finds the condition entirely acceptable and apologized for the owner, Phil Johnson, not being at the hearing. .' . · Planning Commission Minutes July 28, 1994 Page Four In response to a question by the Commission, Friedman said that the new theatre is handicapped accessible. The same entrance of the existing theatre will be used and there is an incline ramp into the auditorium and designated area for wheelchairs and a chair with an arm that raises up so somebody could move from a wheelchair into the theatre chair. Motion was made by Thayer to recommend to City Council for approval of Conditional Use Permit No. 9406-04 with the following changes: add a comma to paragraph 6 on page 2; add phrasing to Condition No. 3 to indicate that another trial period will be imposed but only for one year this time; and add the additional condition proposed by Zimmer reo compliance with applicable laws, building codes and zoning regulations. The motion was seconded by Erickson. All were in favor. V. NEW BUSINESS Thayer asked how everybody is doing on his/her Comprehensive Plan committees. She said she has been kept busy with weekly meetings with the Housing Committee and the van tour and charette. · Erickson said that the Economic Development Committee is coming up with ideas, but she missed the last meeting. The next meeting is scheduled for August 10; 4:00 PM; Pope Marine Park Building. VI. ANNOUNCEMENTS: Next Scheduled Meetings August 11 meeting will be cancelled. Sherwood will be unable to attend the August 25 meeting. VII. ADJOURN Motion to adjourn the meeting was made by Erickson and seconded by Thayer. All were in favor.
