ROLL CALL The meeting was called to order at 7:00 by Chair Lois Sherwood. Other members in attendance were Ernie Baird, Lisa Enarson, and Ian Keith. Cindy Thayer and Karen Erickson were excused. Mark Welch was absent. Staff members present were Judy Surber and Pam Kolacy. II. APPROVAL OF MINUTES Motion to approve the minutes of the February 23, 1995, meeting as read made by Enarson, seconded by Baird. All were in favor. III. COMMUNICATIONS Surber distributed a letter from Harry Holloway III, owner ofa neighboring property, in support of the variance applicati-E:m to be considered this evening. IV. OLD BUSINESS A. Bertram Levy & Roberta Butler, Varianc~ Application #9501-05 - 1. Staff Report (Surber) Surber described the applicants' proposal to construct a single- family home within ten feet of the front property line. A minimum twenty-foot setback is required in the R-1 zoning district. The buildi~g area of the subject site is constrained by the shoreline setback requirement, and by a Restrictive Covenant which limits the height of the building; because of these requirements, the building area is limited to an 850 square foot residence with a one-car garage. The applicant proposes a plan for a 1400 square foot home with a two-car garage, which would be possible with a 10-foot front yard setback. Staff recommended two conditions: 1) the applicants shall submit an application for a Shorelines Permit Exemption before any building permits are issued; 2) applicants are encouraged to limit the clearing on the site, and plant native vegetation to PlanniQg commission March 9, 1995 Page 1 Copied to PCOMM 3/cl/Cls fZ.(J · · · . reduce erosion and slope stability hazards, and minimize the amount of lawn planted. 2. Public Testimony Bertram Levy presented a survey of homes on either side of the building site, and a site plan showing how the footprint of the building would be limited by restrictions. He also showed photographs of the site and the boundaries of the propos~d construction. He noted that the houses on either side of the site have 4.8 and 7.8 foot setbacks from the street. Dr. Levy noted he would be happy to comply with all conditions set by the City to accompany the variance. There was no other testimony. 3. Committee Report (Baird, Enarson) Baird stated he had visited the site and determined that the neighbors' views would not be disrupted by the proposed building. He had no objections to the variance request. Enarson agreed, but questioned whether the requirement for off-street parking spaces is met. Surber noted that the two-car garage would satisfy that requirement. Enarson also strongly endorsed the vegetation and planting conditions for the variance. 4. Commission Discussion and Conclusions. Sherwood stated that she supports protection of the bluff setback. Enarson noted that she strongly supported the conditions for limiting clearing of the site. Motion by Enarson to recommend to City Council for approval of Variance Application #9501-05, as conditioned, with an amendment to Finding No. 8 showing that one letter of comment was received, supporting the variance. Seconded by Baird. All were in favor. V. NEW BUSINESS 1. Judy Surber introduced Hal Hart, the City's new Senior Planner. 2. Surber announced that the City Council had accepted the recommendation of the Planning Commission in the matter of Joe & Agnes Placz, Home Occupation Permit #9501-02. After reading the Planning Commission minutes from the February 23, 1995 meeting, Council felt that the Planning Commission had thoroughly discussed all issues involved and agreed with Planning Commission's recommendation without further public hearing.
