ROLL CALL Acting Chair Karen Erickson called the meeting to order at 7: 10. Other members present were Ernie Baird, Bob Rickard and Cindy Thayer. Also present were staff members Dave Robison and Sheila Spears. City Council Member Jean Camfield was also present. Commission Members Lois Sherwood and Mark Welch were absent. II. ELECTION OF CHAIR Motion was made by Thayer to postpone election of chair until next meeting because two commissioners are absent. Seconded by Rickard. Motion Carried. III. APPROVAL OF MINUTES: None IV. COMMUNICATIONS Dave Robison distributed "Zoning News" for perusal at a later time. v. CURRENT BUSINESS: Environmentally Sensitive Areas Ordinance (geologically hazardous areas) Dave asked if commission members are receiving the Planning magazine yet. Some are, but not all. He asked Sheila to follow up on seeing that all those subscriptions were sent in. The City Attorney will be attending the next Planning Commission meeting (April 2). He will be studying the ordinance this next week. Upcoming Planning Commission meetings were discussed and the following changes were made in the schedule: April 9 - rescheduled to April 16 (No meeting on the 9th; April 16 will be ESA workshop meeting to review final draft of the ordinance; April 22 - rescheduled to April 28; April 23 rescheduled to April 30; April 28 will be a joint hearing with City Council and public testimony will be taken on the draft ESA ordinance; April 30 will be for the Planning Commission only and a final decision will be made on the ESA ordinance. Dave said that the maps are not available yet and hopes to have them for the next meeting but won't make any guarantees, based on past performance. He said the ordinance can stand up without any maps. They are only a guide. Criteria used in classification are irrespective whether it is mapped or not. It is a useful tool but not necessary. Also these maps will not be all inclusive and will be updated periodically. The maps aren't going to show a whole lot. They will show soils which can be indicative of steep slopes and types of vegetation that mayor may not be there, etc. The soil map will be the most definite map. Dave said that we won't know what's really there except for a band - staff will have to go out and make a cursory field ,. . e f1 . i Planning Commission Minutes March 26, 1991 Page Two inspection. Steep slopes and the possibility of wetlands would cue the developer that he is going to have to hire a consultant to do a study or the City can send out its consultant, Lisa Palazzi, to confirm what staff thinks. Staff won't do a delineation of a wetland for category until it has a development proposal in hand. Public Works and Lisa Palazzi will do the first phase assessment this summer re soils, steep slopes, drainage areas and wetlands. We are operating without complete information which makes mapping such a difficult task. There are 16 drainage basins in Port Townsend. When we get a final draft and have the maps maybe we can go out to a few undeveloped parcels and see how they look. This is an interim ordinance and should be able to guide us, without complete maps. Dave reviewed draft 6 and explained the changes since draft 5, stating that we are trying to keep the county and city as similar and consistent as possible. He handed out the latest draft of the County's ordinance for the Planning Commission to compare its format with ours, and asked permission to make the City's purposes more consistent with the County's by adding a couple of purposes under each of the sections in 9.0. The Commission wants to read the County's draft ordinance first. Dave also handed out graphics that will be included in the procedures, and explained that in of itself a 15 degree slope is not hazardous. It needs a couple of other conditions to be so. Dave asked the Commission for support in simplifying the ordinance by taking some of the text out. The Commission agreed on the specific changes he suggested. The Commission wanted something in section 5 "Sensitive Area Permit Requirements" to say that even though emergencies have to be taken care of fast without going through the permit process, that any damage caused to a sensitive area in taking care of an emergency would be restored after the emergency has been taken care of. Dave will include that wording. Dave wants to do further research on allowed activities and restricted activities in Section 9.0 so wants to discuss this at the next meeting. The construction of private trails caused a lot of comment by the Commission. Lengthy discussion ensued concerning setback from the buffer. Dave will get a legal opinion.
