Port Townsend. W A 98368 206/385-3000 PLANNING COMMISSION MINUTES FOR DECEMBER 10, 1992 I. ROLL CALL: 7:00 PM Planning Commission members present at roll call were Mark Welch, Cindy Thayer, Lois Sherwood and Karen Erickson. Bob Rickard, Ernie Baird and Lisa Enarson entered the meeting at 7:05 PM. Staff members present were Darlene Bloomfield and Sheila Spears. II. ~ APPROVAL OF MINUTES Motion to approve the minutes, as corrected, for October 29, 1992, and November 12, 1992, was made by Erickson and seconded by Thayer. All were in favor. ITI. COMMUNICATIONS: Letter from Andrew Thurston · Sherwood read a letter from Andy Thurston asking the Planning Commission to reconsider the Thurston application for a short plat subdivision. Bloomfield reminded the Commission that if if it discusses scheduling or rescheduling that care must be taken not to talk about any specific proposals because this is not a public hearing. Enarson excused herself from the meeting because of a conflict. Bloomfield explained that the Commission can talk about the Thurston request procedurally only and asked if they wanted to set a hearing to reconsider the proposal. Bloomfield explained that if Thurston amends the original plat then it can be reconsidered by the Commission without any additional application. A new proposal would require a new application. The Planning Commission agreed to re-hear the Thurston proposal at its February 11, 1993 meeting. OLD BUSINESS Enarson returned to the meeting at this time. A. Rezone Application #9210-06, William Cunningham 1. Staff report (Bloomfield) · Bloomfield stated that Draft A recommends approval of the rezone and Draft B recommends denial. The findings of fact are the same in both drafts. She reviewed Draft A, and read the findings of fact and conclusions. She read the conclusions only of Draft B. She said that the applicants and their representatives are in attendance at this hearing. · · · Planning Commission Minutes for December 10, 1992 Page Two Bloomfield explained that the historical residence on the site is being painted and refurbished on the inside. It was made into three units during WW IT. Structural requirements would have to meet the Uniform Building Code, but historic structures don't always have to meet the same stringent requirements as new buildings. Bloomfield clarified the difference in total square footage of the building submitted on the two drawings. She explained code definitions of apartment house and multi-family dwelling. 2. Public testimony Cunnningham submitted the rezone application while Joe Finnie was in the process of buying the property. Joe Finnie has completed purchase of the property and he stated that his intention is to restore the structure as a historical residence and to move here in the next five years. He said that he has no intention of turning the structure into a Bed and Breakfast, but does intend to rent out three apartments for a period of two to five years. He said that he may move into one of the apartments in three years. Finnie said that he plans to restore the exterior and replace the roof. He asked for questions of his intentions. Bloomfield said that she could add a finding to the report to make the ownership clear. Dale Petzel, the real estate agent that represented the sale of the property explained that the house is in real disrepair and she feels the City is lucky to have someone interested in upgrading the house. She said that Mr. Finnie has refurbished a victorian house before. Mr. Finnie has indicated a willingness to fulfill the requirements on this rezone, including a drainage plan to get the current roof drainage out of the city sewer system. She read parts of a letter into the record from Community Action Council (CAC) supporting that the applicant is meeting demands for affordable housing. Petzel said that Mr. Finnie plans no changes to the outside except for the city parking requirement. Bloomfield identified that the letter from CAC would be Exhibit 5. Margo Nitzsche, Real Estate Agent, explained the differences in the two drawings of the plan submitted. She said that 2,958 is the total liveable square footage. Marie Shirley spoke in opposition to the application saying that she is absolutely against any rezone in the neighborhood. She said that it is presently zoned R-l and that is why she moved to the neighborhood. She said that the structure was used as apartments only during WW IT and has not been used as an apartment in a long time. She also pointed out that most families have two cars. Wayne Hackett asked if the property transferred in the future, would the property then remain R-ITI, and expressed concern about the value of surrounding properties. Public testimony closed. Committee report (Thayer/Baird) Thayer said that the primary questions have been answered but that buffering of the parking plan is still one question. She said there is no doubt about the need for affordable housing but questioned whether the rents stated by the applicant meet the definition for affordable housing. Thayer said there is a definite need for rentals and this area has been sort of a mich mash of residential, and that if the City is inclined to do this, it might be the area. Baird is supportive of the proposal, and said there is a need for rental units and this proposal is not inappropriate given the neighborhood setting. He said this proposal seems desirable because the City is going to get some more rental units and renovation of a historical building. He also wants the parking buffered from the street. Erickson said that she would rather see these types of homes used for apartments rather than Bed and Breakfast Inns and she would like to see that owners have to live in the restored victorians because it shows care for the building and they have control over the effects on the neighborhood. She asked if there is a way to condition this. Bloomfield said that for tourist homes and Bed and Breakfast Inns there is that residency requirement. Thayer said she feels that for the owner to be required to live in the unit is too restrictive. · Enarson asked if the figures used in the CAC letter are appropriate for affordable housing and if the proposal really meets the definition for affordable housing. She also shares concern about the parking and wants it buffered from the neighbors. Sherwood wants Condition #6 added to the report: "Parking plan shall comply with PTMC including placement of required parking places, access isles and appropriate buffers." Also, Bloomfield will note in the report that Joe Finnie is the applicant. Sherwood asked what the history is for rezoning part of a block, since in the past, the City has shied away from it. Erickson said that most recent rezones were on vacant land. Sherwood said this rezone is different and except for a few more cars there will be no noticeable change to the neighborhood. Sherwood made a motion to recommend approval with noted changes. Seconded by Baird. Sherwood made a motion to add the word "historical" to condition #2. Seconded by Baird. All were in favor. Sherwood explained to the applicant that the application will be forwarded to City Council for consideration: · V. NEW BUSINESS Bloomfield asked to schedule a meeting so that Kit Perkins, Planner, could use the Planning Commission as a test group for PT 21.
