Planning Commission Minutes
Business Meeting
August 19, 1993
I. ROLL CALL:
Chair Lois Sherwood called the meeting to order at 8:00 PM. Members present were Karen
Erickson, Bob Rickard and Cindy Thayer. Lisa Enarson and Ernie Baird were excused. Mark
Welch was absent. Staff members present were Darlene Bloomfield and Sheila Spears.
II. APPROVAL OF MINUTES: July 29, 1993
Motion to approve the minutes of July 29, 1993, as corrected, was made by Erickson and
seconded by Rickard. All were in favor.
III. COMMUNICATIONS
A. Letter (8/12/93) to the Planning Commission from Mr. & Mrs. J. J. Kircher re
Ramey Conditional Use Permit #9306-14

IV. OLD BUSINESS
A. James P. Ramey, Conditional Use Permit 9306-14
1. Staff Report (Bloomfield)
Erickson excused herself from the proceedings because of a conflict of interest.
Bloomfield reported on the Findings of Fact and Conclusions for James Ramey's Conditional
Use Application to construct a 9-unit motel in a C-II zone.

Applicant James Ramey said that he had nothing to add to the report.

Leona Brown (1940 Jefferson) requested that consideration be given to on-site pet provisions.
Ramey said that pets would not be allowed in the motel and he does not plan to provide a
designated pet area. Commission asked if there is anything in the code about pets.
3. Committee Report (Rickard/Enarson)
Rickard stated that his only concerns are things that are beyond the control of the Planning
Commission. Since the proposed motel fronts Kearney Street instead of Sims Way there will
be little opportunity for landscaping. Rickard said that he hopes the applicant takes that into
account in whatever his landscaping plan is since this is what people will see when entering Port
Townsend. Thayer asked if the access onto Sims Way is a right turn only. Bloomfield said
that it is striped that way.
4. Commission Discussion and Conclusions
Rickard said that in the WAC it appears that a motel cannot be built because of the need for a
25 ft setback from the power lines. He asked if the applicant has had any further discussions
with Puget Power. Bloomfield said that Puget Power has indicated that the 25 ft setback
requirement may not be set in concrete. Ramey said that if it does stand, then the motel cannot
be built.
Rickard asked if the Planning Commission recommends for approval of this Conditional Use
Permit and it turns out that in order to work things out with Puget Power, the building has to
be moved elsewhere on the site, does it come back to the Planning Commission? Bloomfield
said that in the past City Council has sent it back to the Planning Commission if the change in
the plan is substantial. If the change is not substantial City Council will take action.
Rickard said that he likes the idea of a right-turn only onto Sims Way.
There was a short discussion about landscaping in the eight foot setback and whether it should
accommodate pets. Sherwood said different landscaping would be required for aesthetics than
for pets. Thayer said she doesn't think the applicant should be obligated to provide an area for
pets since they aren't allowed in the motel. Decision was made that this is not a part of this
application.
Rickard asked whether there is any review of the location of landscaping as a part of the
building permit application. Bloomfield said that generally, landscaping is required for parking
areas. She said it would depend on the final design but since parking already exists she doesn't
think the buffer would be required.
Staff will word a finding about people not obeying the striped regulations and add a seventh
condition that the applicant will put up a sign "Right-Turn Only onto Sims Way."

Motion was made by Rickard to recommend approval with the provisions that grant Conditional
Use Permit #9306-14 with Findings of Fact 1-16 and Conclusions 1-5 and conditions 1-7.
Seconded by Thayer. Thayer, Rickard and Sherwood voted in favor.
B. William Schwilke, Variance Application 9307-10
1. Staff Report (Bloomfield)
Karen Erickson re-entered the meeting at this point.
Bloomfield reported on the Findings of Fact and Conclusions for a setback variance from the
rear setback on William Schwilke's Variance Application.
Erickson asked for clarification of the fee structure for the two applications (re-zone and
variance).
2. Public Testimony
Schwilke asked only that the Planning Commission approve his application.
3.
Committee Report (Baird/Rickard)
Rickard said he feels that the requested setback is sufficient and asked staff if property owners
were notified. Bloomfield answered that they were and that no comments were submitted.
Nobody has objected.
4. Commission Discussion and Conclusions
Motion was made by Rickard to recommend to City Council approval of Variance #9307-01 with
Findings of Fact 1-7, Conclusions 1-6 and Conditions 1-3. Seconded by Erickson. Thayer,
Erickson, Rickard and Sherwood all voted in favor.
C. City of Port Townsend, Variance Application 9308-03
1. Staff Report (Bloomfield
Bloomfield reported on the Findings of Fact and Conclusions for the City's application for a
fence height variance and stated that Bob LaCroix, from Water Quality, was present to represent
the City.

2. Public Testimony
He said that security is common and necessary and that the City is interested primarily in public
safety.
3. Committee Report (Thayer/Erickson)
Applicant was asked whether the fence will follow the existing fence line. LaCroix said that it
would except for the side facing the high school. The City may put it closer to the property line
on that side instead of next to the reservoir. The area is brushy and has wild cherry trees.
LaCroix said the latest trespass included the valves being opened, filling the reservoir and
boating. This is a problem for liability. Building the fence would reduce the City's liability and
a fence is cheaper than liability insurance. LaCroix said the valves cannot be made tamper-
proof.
Bloomfield asked for the latitude to update the language in the Findings and Conclusions
concerning fence height restrictions in the P-l zone.
LaCroix said that a 6 ft fence with barbed wire on the top is minimal to do the job.
4. Commission Discussion and Conclusions
Motion was made by Thayer to recommend approval of Variance #9308-03 with the changes
made by the Planning Commission. Seconded by Rickard. Thayer, Erickson, Rickard and
Sherwood all voted in favor.
V. New Business
Bloomfield discussed the scheduling requests in two letters submitted in response to the Green
Short Plat Application. She said the proposal is controversial in the neighborhood and explained
that she wanted the Planning Commission to understand the applicant and one neighbor cannot
attend the same meeting due to scheduling conflicts. She wanted the Commission to have this
information before scheduling the hearing. The hearing was scheduled for September 9, 1993.
Port Townsend School District applications for Conditional Use Permits for Grant Street School
and High School additions were scheduled for hearing before the Commission on September 30.
Port Townsend School District Rezone and Conditional Use applications for the New Middle
School were scheduled for hearing on October 14.

Sherwood said she would attend the School District hearings so there would be a quorum but
that she would have to excuse herself because she is employed by the School District. She
suggested that Commission members be called the day before the hearings so that there will be
a quorum.
Motion to adjourn the meeting was made by Thayer and seconded by Erickson. All were in
favor. Meeting adjourned at 9:05 PM.
