Meeting of september 27" 1990
I. Roll Call
Mr. Carman called the meeting to order at 7:35 p.m. other members
present were Lois Sherwood, Karen Erickson, Jim Tavernakis and,
Alan Carman. Also present were staff planners Rick sepler and Dave
Robison.

not be in attendance.
II. communications.
Dr. Levy, who had previously been before the commission with a
variance request, asked the Commission to consider the rephrasing
of the variance criteria. The city Council did not make a decision
on his variance request but asked the Commission to review the
criteria of the variance.

Some discussion followed within the Commission. Dr. Tavernakis
asked that the Council submit a letter of request to consider a
change in the variance criteria.

The Commission received a flyer for a planning conference to be
held in Kennewick.
III. Old Business
A. Short Plat Appl. 9002-05, Karen and Jeff Porter
Mr. sepler explained to the commission that staff did not receive
a site plan in advance and consequently a staff report was not
available. He suggested that the public hearing be held since
notice was given, but that the Commission continue the meeting for
Planning Commission's consideration of the matter.
Mr. Carman left the room due to a possible violation of the
appearance of fairness doctrine.

Jeff Porter, applicant, stated that the intention of buying the
land was to divide the one existing lot into two. The fire chief
noted that a wider easement than was originally proposed was
needed. So changes were made to the plan. The Porter's proposes to

e build a house on the newly created lot.
virginia Wolff, 1508 Jackman of Lot 3 of the Gregory Short Plat,
asked for clarification on the location. She had concerns over the
drainage problems and objects to the short plat. She stated that
Mr. and Mrs. Thoms, neighboring property owners, did not receive
notification of the hearing, and passed out a letter of opposition
written by Mr. Thoms. Ms. Wolff stated her concerns for the
possible development in the area if everyone developed the land to
capaci ty after division and stated her concerns over possible
traffic generation.
Mr. Kosec read letters of opposition into the record. Letters read
were from Mr. Thoms, Virginia cupp, and Mr. and Mrs. Dressler.
Ms. Porter, applicant, stated that the new proposal will dedicate
a 45-foot access easement and add a fire engine turn-around.
Ms. Sherwood moved to continue Short Plat Appl. 9002-05, Karen and
Jeff Porter to November 8, ],.990. Ms. Erickson seconded and all
were in favor. The motion was amended to state that public
testimony will be taken during that meeting. All were in favor.

B. Variance Appl. 9008-01, Garth and patty Hatfield
Mr. Carman returned to the meeting at this time.
1. Staff Presentation.
Mr. Robison distributed a plot plan of the proposed variance and
reviewed the draft Findings of Fact and Conclusions. Draft A
recommends approval while Draft :a recommends denial. The applicant
proposed to construct an adjoining enclosed garage with a family
room above to their existing home at 1740 Lawrence street.
Mr. Tavernakis asked for a clarification on the plot plan.
2. public Testimony
Garth Hatfield, applicant, stated that the proposal is
architecturally aesthetic and requests the variance to make the
building flush with the existing house.
Public Testimony was closed.
3 . Commi ttee Report
Mr. Tavernakis stated that his original concern was lot coverage
but it appears the proposal is within the zoning requirements.
Mr. Carman stated that it is the minimum variance required. Any
other location would be difficult.

Garth and Patty Hatfield, adopting the Findings and Conclusions as
presented by staff. Mr. Tavernakis seconded.
Ms. Erickson commended the applicant for a job well done on filling
out the application completely.
A vote was taken on the motion on the floor. All were in favor of
recommending approval.
C. Short Plat Appl. 9008-03, Barbara Williams
1. staff presentation and Review
Mr. Sepler reviewed the Findings of Fact and Conclusions. Draft A
recommends approval while Draft B recommends the proposal be
denied. The applicant requests division of an existing irregular
shaped parcel into two lots. A variance is requested to allow less
than the minimum lot area for the northern most lot.
Mr. Carman stated that Chapter 18 (Sub-Division) was written with
the intention of including easements in the gross lot area. Mr.
Sepler stated that this question should be researched.
Mr. Sepler distributed an alternative subdivision layout which was
submitted by the applicant just prior to the meeting.
Ms. Erickson asked a question of clarification regarding the
location of the proposed easement.
2. Public Testimony
Barbara Williams, applicant, stated that she proposes to have a
small home on the newly created lot. Ms. Williams reviewed the
proposed site and stated that the density would not be too great
and that she intends to build only one floor so would not obstruct
views. She reviewed the lot area.
Dean Lansing, 900 Maple street, stated that his property is
directly across oak from the proposed house. The access to the new
lot would be from what he uses for a driveway and stated he had no
problem with the proposal. Mr. Lansing stated that his lot is
steeper than the sUbject property and has no problem on his sight
and foresees none for Ms. williams' lot. Mr. Lansing stated that
the neighboring house, the Mathias house, is a two-story and should
have no problem with view.
Jim Mathias, neighboring property owner, the proposed house would
be directly adjacent to his living area. Once the short plat is
approved the lot could be sold and then built to it zoning
potential. He suggested that a 24-foot height limitation b.e placed
on the property using the 200 or 202 elevation as a reference

point.
Bob Martin, a neighboring property owner, stated that he has no
objection as long as a height limitation is addressed.
Cappy Mathias, neighboring property owner, stated that she feels
that a height limit is necessary and suggests that some provision
be made to save trees on the property.
Ms. Martin stated that a height restriction should be a part of the
application. She also felt that a code should be installed to save
views against growing trees.
3. Committee Report
Dr. Tavernakis stated his concerns for the potential for wood
burning stoves in this area because of higher density and slope.
He feels the character of the neighborhood would be changed with
the short plat and that the variance is a result of the actions of
the applicant.

Ms. Erickson asked for clarification on the need for a variance.
Mr. Sepler stated that the variance may not be necessary if the
easement area were to be included in the calculation of lot area.
Mr. Tavernakis stated that he had a personal involvement in the
easement as square footage question and that City Attorney Keith
Harper stated that the easements do not count in lot coverage
square footage.
Ms. Erickson asked for clarification of the location of utility
easement. Ms. Erickson stated she had difficulty agreeing with the
conclusions for the approval of the application. She stated her
concern for setting a precedence for allowing less than the
required 7,200 square feet per lot. She stated that slope is not a
good reason for the variance. She discussed the code on buildable
terrain. She felt there is just not enough land to short plat on
this site and sees no hardship.
Mr. Tavernakis stated that he agrees with Ms. Erickson's
interpretation of the short plat ordinance on buildable terrain.
Mr. Carman stated that easements in most jurisdictions are counted
in the gross area of the lot. Mr. Carman felt the variance was not
necessary.
Ms. Sherwood asked Mr. Tavernakis what his experience was with the
issue of lot area.

Mr. Tavernakis stated that the city attorney opined that easements
do not apply to access or utility easement for lot coverage.

Mr. Sepler explained to the Commission that the applicant would
have sufficient area without the variance by creating a long 9-foot
strip of property along the northeast property line. staff
encouraged the applicant to create a more reasonably shaped lot
which made necessary the variance.
Mr. Carman stated that creating an odd shaped lot to meet the
letter of the law seemed nonsensical.
Some discussion followed over the options for dividing the subject
property.
Mr. Tavernakis felt that the vacation of Cosgrove is the action of
the applicant and therefore does not meet the criteria for a
variance.
Mr. Tavernakis moved to recommend denial of Short Plat Appl. 9008-
03, Barbara Williams, as presented in Draft B of the Findings of
Fact and Conclusions. Ms. Erickson seconded. The motion carried 3-
2 with Mr. Carman and Mr. Kosec voting against.
The Commission discussed the request by Dr. Levy for a review in
the variance criteria.
Discussion followed over what the Council would like the Commission
to address on the Levy variance. The Commission discussed the need
for a change in the variance criteria.
Mr. sepler suggested that a memo b.e prepared from staff explaining
the situation and what the Council has asked the Commission to do.
Mr. Kosec asked for clarification on the Campbell/Hogue project.
Mr. Sepler stated the project has been scaled down and an
environmental checklist and subdivision application are in the
process.
Some discussion followed on the Townsend Meadows project. Mr.
Sepler stated that the project is going forward with supervision by
the public works director.
Mr. Carman asked Mr. Sepler if he was able to find conferences for
the commission members to attend. A list of possible conferences
will be forwarded to the commission.
v. Announcements
Mr. Kosec suggested that the Commission wait unti 1 the new
commissioner was on board prior to elections for the vacated
position of vice chairman.
Ms. Sherwood told the Commission that she will likely not be able

to attend the meeting of October 10, 1990.
Mr. Robison suggested some available conferences for the
commissioners regarding land use. Mr. Robison suggested that an
in-service training with staff, the Commission and the Council may
be another option.
