A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF PORT TOWNSEND GRANTING FINAL
PLANNED UNIT DEVELOPMENT AND BINDING SITE PLAN
APPROVAL FOR PORT TOWNSEND ECOVILLAGE,
APPLICATION LUP10-046
The City Council of the City of Port Townsend, Washington resolves as follows:
WHEREAS, Cornelis (Kees) and Helen Kolff have petitioned the City for final approval
of their Planned Unit Development (PUD) and Binding Site Plan (BSP) covering their mixed-use
residential development known as the Port Townsend Ecovillage (LUP10-046). Port Townsend
Ecovillage (PTEV) is located between 35a' and 37a' Street, west of San Juan Avenue in central
Port Townsend; and,
WHEREAS, the original preliminary PUD and BSP applications were submitted on or
about July 8, 2008 (LUP08-063) and sought approval for an "intentional" community consisting
of a mixture of construction types and uses. The property is located on 7.5 acres dispersed across
two (2) existing tax parcels, which are separated by a 16.5-foot wide City-owned tax parcel.
Through the BSP process, the underlying properties would be replatted, a portion of an internal
right-of--way would be vacated, and several previously reserved public utility easements would be
extinguished. hi their place, two (2) new lots are being created with new public utility, non-
motorized and fire lane easements being reserved. As replatted, Parcel A of the BSP is
approximately 4.34 acres in size while Parcel B is approximately 3.16 acres; and
WHEREAS, up to 24 additional dwelling units, in addition to the three (3) existing units
currently on site, are proposed within PTEV. Dwelling units may be constructed as detached or
attached (duplex, triplex, or fourplex) housing types. Accessory Dwelling Units (ADUs) are
allowed, but each dwelling is included in calculating overall density. In addition to the
residential component, the request includes a future clubhouse on the southern parcel (Parcel A).
A maximum of three (3) additional dwellings are allowed on the northern parcel (Parcel B) along
with future small-scale commercial operations on the common land which may include a farm
stand, a commercial greenhouse and amulti-purpose learning center. On-site parking areas
within each parcel are required in support of the proposed dwellings and other approved uses.
The PTEV Homeowners Association will develop most of the land for the common use and
enjoyment of its members. Each residential site would be developed by private individual
owners, who will become members of the Association and collectively own all common land and
improvements therein; and,
WHEREAS, following an open record public hearing on July 8, 2009, the PTEV
applications were granted preliminary approval, subject to certain conditions, by the City's
Hearing Examiner on August 4, 2009. Following a request for Reconsideration by the
applicants, the Hearing Examiner issued a Revised Final Decision on September 28, 2009.

Following this, the applicants applied for and were granted Minor PUD Modifications to the
preliminary approval through LUP10-015; and,
WHEREAS, the Public Works Director has reviewed and approved the construction
plans for all required infrastructure and found them to be in compliance with the Hearing
Examiner's decision. Furthermore, the Public Works Director has previously approved a
financial security sufficient for installation of the required improvements. The Public Works
Director recommends that recording of the BSP occur once sufficient monies to address the
applicant's preparation of "as-built" plans for the completed infrastructure are provided to the
City; and
WHEREAS, the Development Services Director has found that the final PUD and
Binding Site Plan request is in conformance with the Hearing Examiner's preliminary PUD
decision, complies with applicable environmental mitigation measures, and includes appropriate
measures for recording to title a Planned Unit Development Agreement (PUDA) signed by both
the applicant and the City. Further, the fmal PUD and Binding Site Plan approval for Port
Townsend Ecovillage is consistent with Chapters 17.32 and 18.20 of the PTMC; and
WHEREAS, the City Council has reviewed the proposal and concurs with the
Development Services Department's determination; and,
NOW, THEREFORE, BE IT RESOLVED, the City Council hereby APPROVES Port
Townsend Ecovillage Planned Unit Development and hereby directs staff to facilitate recording
of the final Binding Site Plan with the County Auditor once an appropriate financial security for
the preparation of "as-built" infrastructure drawings has been provided to the City. Furthermore,
the City Manager is hereby authorized to sign the required PUD Agreement on behalf of the City
after it has been reviewed and approved by the Directors of Public Works and Development
Services in consultation with the City Attorney.
ADOPTED by the City Council of the City of Por[ Townsend at a regular meeting
