Townsend, WA 98368 Project Location and Legal Description: Decatur Street intersection with Pt. Townsend Bay Proposal: Transferal of a house from barge to city street and then movement of house away from the shoreline to an upland location outside of shoreline jurisdiction (5207 Landes Street). Adjacent Water body: Port Townsend Bay SMP Shoreline Designation: PT Urban Waterfront, Regional Services Commercial sub- - district Findines & Conclusions 1. The proposal made by the applicant to undertake the development described above within the waters of the City of Port Townsend and/or its associated wetlands is exempt from the requirement of a substantial development permit. Specifically, the proposal constitutes: Construction of asingle-family residence as provided for in Section 3.402, #5 of the City's Shoreline Master Program. While the ultimate destination for the home is an upland site outside of shoreline jurisdiction, the location where the house would be brought ashore is at the shoreline terminus of Decatur Street. 2. As shown on the submitted site plan and narrative, the applicant wishes to move an existing house via barge from Canada to Pt. Townsend. The barge would arrive at a high tide, secure itself with land lines to two (2) on-shore trucks to stabilize that end of the barge. The tugboat used to move the barge will stabilize the stern. An on-shore crane will be used to hoist ramps into place, spanning from Decatur Street to the barge. The house is then driven off of the barge and transported to its upland building site. Once the house is off of the barge, all ramps and land lines are removed. The barge is then towed away. At no time will the barge rest on the intertidal or subtidal surfaces. The time frame for the above work is approximately 1.5 hours. In addition to Shoreline jurisdiction, the barge site is located within several identified Critical Areas including Fish & Wildlife Habitat, Seismic, Aquifer Rechazge and Frequently Flooded. So long as the barge does not ground and no additional erosion of the medium height shoreline bank occurs, the proposed activity is minor in nature creating no impacts to the shoreline environment or critical areas. Furthermore, no off-site impacts have been identified. Condition: can be imposed through this Shoreline Exemption & Minor Critical Area permit to ensure that impacts do not occur. 4. Subject to appropriate conditions, the proposal will not materially interfere with the public use of public lands and waters or the private use of adjacent private lands nor will it result in any material expansion or change in use beyond that previously existing. Conditions 1. All development shall be in substantial conformance with the development plans submitted in the application for Shoreline Exemption & Minor Critical Area review. There shall be no further expansions to or addition of any structures seaward of the existing development without prior review for conformance with the Shoreline Master Program and any other applicable laws and ordinances. 2. This Shoreline Exemption & Minor Critical Area permit does not excuse the proponent from complying with other local, state and federal ordinances, regulations, or statutes applicable to the proposed development. No use of mechanized equipment directly on the beach is permitted as part of this shoreline exemption and the barge work shall occur at high tide. Upland use of equipment for this project, such as the crane, trucks, ramps & landlines shall be as far away from the Ordinary High Water Mazk (OHWM) as possible to accomplish the house moving. 4. The applicant shall be responsible for notifying all neighboring businesses, all overhead utility providers and the City Police and Fire Departments of the approved and pending work and for securing any necessary rights-of-access across intervening properties. Furthermore, the applicant is responsible for communicating with adjacent properly owners to ensure access interruptions to the public and private parking areas abutting Decatur Street are minimized. Any damage or impacts to public or private lands along Decatur Street or along the house-moving route are the applicant's responsibility to restore to a condition as good as previously existed or better. If barge work or other equipment inadvertently damages the shoreline environment, the applicant shall notify the City and any other responsible agencies (i.e. State Fish & Wildlife, Ecology) immediately. The applicant shall be ~• 6. 9 responsible for repairing the shoreline to its preexisting condition, or better, to the satisfaction of the responsible agencies. The applicant must obtain a City of Port Townsend moving permit prior to placement of the house onto the upland location. The applicant must obtain a Hydraulic Project Approval (HPA) from the Department of Fish & Wildlife prior to undertaking any activities on the beach. To avoid environmental health hazards during the barge work, emergency spill and cleanup procedures shall be explained to all workers on the site and a point of contact will be designated. All mechanized equipment involved with the barge work shall be inspected for leaks. Any equipment leaking hazardous materials is prohibited from conducting any work seaward of the Ordinary High Water Mark (OHWM) or within 200 feet upland of the OHWM until the leak is repaired. All construction contracts shall specify that all diesel, gasoline and air-powered equipment must be properly muffled or silenced. In consideration of the above, the proposal is found exempt from the requirement of a Davi Wright, P.E.
