into an amendatory agreement between the City
of Port Townsend and William W. Grace to
amend the Property Use and Development
Agreement which governs development of the
Townsend Meadows Planned Unit Development.
WHEREAS, the City of Port Townsend and William W. Grace,
hereinafter referred to as "Developer" have entered into a
certain Property Use and Development Agreement, hereinafter
referred to as "Agreement", governing development of the Townsend
Meadows Planned Unit Development; said Agreement is dated August
24, 1987, and recorded in Volume 260, pages 159-162 in the
official records of the Jefferson County Auditor, and
WHEREAS, the Developer has requested certain amendments to
the Agreement by letter dated October 7, 1988, from John M.
Vincent, and
WHEREAS, the City Council has found that in order to
facilitate development of needed retirement housing afforded by
the Townsend Meadows Planned Unit Development several of the
amendments requested are in the public interest and in
conformance with Chapter 17.40, Planned Unit Developments--
Residential, of the Port Townsend Municipal Code; Now,
Therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT TOWNSEND
that the Mayor is hereby authorized to execute on behalf of the
City an amendatory agreement with William W. Grace for the
purpose of amending the Property Use and Development Agreement
governing development of the Townsend Meadows Planned Unit
Development, which Agreement shall be substantially in the form
attached hereto as Exhibit A.
Passed by the City Council of the City of Port Townsend and
signed by the Mayor this Twentieth day of December, 1988.
