A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
PORT TOWNSEND FINDING AND DECLARING AN EMERGENCY;
WAIVING THE REQUIREMENTS OF RCW 39.80; AUTHORIZ-
P~G COMPLETION AND EXECUTION OF AN ENGINEERING
AGREEMENT WITH PERATROVICH, NOTTINGHAM & DRAGE,
INC.
WHEREAS, the City of Port Townsend oyes the Pope Marine Com-
munity Center building located on or near the foot of Madison
Street abutting Port Townsend Bay; and
WHEREAS, the foundation for the build%ng must be rehabil-
itated, which work may include the provision of new piles and
caps; retention of the building in the same location; a provi-
sion for a walkway on the North side of the building; and com-
patibility of the work with the potential future rehabilita-
tion of the City dock itself; and
WHEREAS, the City Council finds pursuant to RCW 39.80.060
and other applicable laws that an emergency exists which re-
quires the immediate execution of the work involved; and
WHEREAS, such 'finding of an emergency is based upon the
following facts:
(1) The status of the property and buildin~ as set forth
on attached Exhibit 1, incorporated herein as if set forth in full;
(2) The severe winds and storms experienced recently has
further endangered the building in view of its condition, and the
building is now starting to tilt.
(3) The Dept. of Fisheries has directed that all work
to the building and foundation which must.de done in water must
be completed by March 15, 1991, due to various issues pertaining
to the fish habitat in the area.
WHEREAS, based upon said emergency, the requirements ap-
plicable for selection of the engineer to perform engineering
work pursuant to RCW 39.80 should be waived; and
WHEREAS, Peratrovich, Nottingham & Drage, Inc., is quali-
fied and able to perform engineering services necessary for re-
habilitation of the foundation for the Pope Marine Community
Center, for a maximum fixed fee price of $4,800; now, therefore,
BE IT RESOLVED by the City Council for the City of Port
RESOLUTION - 1 -
Townsend that the Mayor, Public Works Director and City Attorney
for the City be and they are here and hereby authorized to nego-
tiate and prepare a contract between the City of Port Townsend
and Peratrovich, Nottingham & Drage, Inc., substantially in the
form attached hereto as Exhibit A and Exhibit B, with such
changes or modifications in the terms thereof as those officials
deem best in the interest of the City of Port Townsend and in
having the work completed; and
BE IT FURTHER RESOLVED by the City Council for the City of
Port Townsend that the Mayor and the City Clerk of the City be
and they are here and hereby authorized to execute on behalf of
the City such contract as negotiated and prepared by those offi-
cials; and
BE IT FURTHER RESOLVED that the City Treasurer be and he is
here and hereby authorized and directed to execute the City's
warrant or warrants in payment for the compensation of the en-
gineer for such work pursuant to the contract.
Passed by the City Council for the City of Port Townsend,
approved and signed by the Mayor of the City this 18th day of
December, 1990.
