HomeMy WebLinkAbout91-21RESOLUTION NO.~f-~ A RESOLUTION OF THE CITY COUNCIL FOR THE CITY OF PORT TOk~SEND GRANTING AN EXTENSION OF TIME UNDER SHORELINE APPROVALS FOR UNION WHARF k~EREAS, the City Council for the City of Port Townsend, hav- ing considered the history of the proposed development of Union W~arf by Union Wharf Associates (Ut~A) and l~A's letter addressed to the Mayor of the City dated February 21, 1991, together with the testimony, public comment and documents which have been presented or generated regarding this proposed project, finds that: (1) Shoreline Substantial Development Permit SH2-87 and Shoreline Conditional Use Permit 590-14-6921 were approved by the City on or about March 7, 1989, for the proposed development of Union %~arf by UWA, and (2) L~A has undertaken numerous steps to obtain all re- quired permits and approvals to proceed with the oroject, including but not limited to those items set forth on attached EXHIBIT A, "Agency List and Summary," dated January 18, 1991, and (3) UWA and the City have attempted at length to complete negotiations for a lease of the property to UWA to oroceed with the development, and (4) With respect to other agencies, unforeseen issues pertaining to the existence of eelgrass beds have arisen with which IB~A is attempting to deal, and (5) Completion of a lease or other arrangemen~ with the City, addressing issues with respect to eelgrass, and ~=~ mat- ters have taken more time than the parties involved had anticipated, and (6) U%IA has spent substantial amounts of funds, and ~,TA, the City and other agencies have expended substantial time and re- sources to allow this ~~~- ?- -],~' -- · ~ ' and all parties have tried to do so diligently and zn good faith, and (7) L~A appears to have undertaken substantial progress toward construction and completion of the project within two years of issuance of the Shoreline permits but that a one-year extension of time should be granted to do so to remove any auestion as to compliance with such time period, and RESOLUTION - 1 - (8) Reasonable factors therefore exist to grant the ex- tension as requested, and (9) Notice of the proposed granting of the extension was FAXed and mailed by the City prior to this date to the Department of Ecology, parties of record and certain other agencies, entities and individuals, and was announced at the Council's regular meeting March 5, 1991. Now, therefore, based upon these findings and the other facts available to the City, BE IT RESOLVED by the City Council for the City of Port Town- send that the two-year time period in which to undertake substan- tial progress on this project under all the Shoreline permits as issued to UWA be and is hereby extended for one additional year. BE IT FURTHER RESOLVED that the Mayor of the City may execute any other documents, if any be necessary, to grant this extension, and to cause a cooy of this Resolution and any other appropriate correspondence to be sent to the Department of Ecology and other pertinent parties.
