Agent to receive claims against City
RESOLUTION NO. 10-001
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PORT TOWNSEND,
WASHINGTON, APPOINTING AN AGENT TO RECEIVE CLAIMS AGAINST THE
CITY UNDER CHAPTER 4.96 RCW, AND RESCINDING RESOLUTION 01-038
WHEREAS, Chapter 4.96 RCW requires that all claims for tortious conduct against a
local governmental entity must be filed with the governmental entity before a civil suit may be
filed; and
WHEREAS, Chapter 4.96 RCW further requires that the City appoint an agent to receive
any claim for damages against the City; and
WHEREAS, the identity of the agent and address during normal business hours of the
City are public records and shall be recorded with the Jefferson County auditor; and
WHEREAS, all claims for damages shall be presented to the agent within the applicable
period of limitations within which an action must be commenced; and
WHEREAS, Council Resolution 01-03 8 ((September 4, 2001) previously identified the
City Manager as the agent to receive claims, and the Resolution needs to be updated to correct
the address in that Resolution.
NOW, THEREFORE, BE IT RESOLVED,
1. The City Council for the City of Port Townsend appoints the City Manager, or the
Manager's designated agent (designation to be in writing), as the City's agent to receive any claim
for damages against the City under Chapter 4.96 RCW. The agent may be reached during the
normal business hours of the City at Office of City Manager, 250 Madison Street, Suite 2;
telephone (360) 379-5047, Facsimile (360) 385-4290, or such other address as the agent office
may be located.
2. Resolution 01-038 is hereby rescinded.
ADOPTED by the City Council of the City of Port Townsend at a special business
meeting thereof, held this twenty-fifth day of January 2010.
