A RESOLUTION WITH CERTIFICATIONS OF COMPLIANCE
For Advanced Planning Activities
WHEREAS, The City of Port Townsend is applying to the State of
Washington for a Community Development Block Grants
WHEREAS. it is necessary that certain conditions be met as part of
the application requirementss
WHEREAS, The City of Port Townsend shall agree to comply with all
applicable federal and state regulations in the event that this
application is selected for funding, and that Brent Shirley, Mayor,
is authorized to submit this application to the State of Washington
on behalf of The City of Port Townsend~
NOW, THEREFORE, be it resolved=
The City of Port Townsend authorizes the Clallam-Jefferson Community
Action Council (CAC) to submit on behalf of the City a Community
Development Block Grant application to the State of Washington for an
advanced planning only grant in the amount of $24,000 in support of a
housing rehabilitation and weatherization program~
The City of Port Townsend will comply with applicable federal and
state regulations including environmental reviews
The City of Port Townsend has provided citizens with reasonable
advance notice of, and the opportunity to comment on the proposed
housing and community development activities and the estimated cost
of the project in relation to the activities planned to benefit low-
and moderate-income personss
The City of Port Townsend, with the assistance of the monies
requested, will establish a plan to minimize displacement as a result
of activities assisted with CDBG fundss and as prescribed in said
plan will assist persons actually displaced as a result of such
activitiess
The City of Port Townsend will conduct and administer its program in
conformance with Title VI of the Civil Rights Act of 1964 and Title
VIII of the Civil Rights Act of 1968~
The City of Port Townsend has adopted or will adopt and enforce a
policy prohibiting the use of excessive force by law enforcement
agencies within its jurisdiction against any individuals engaged in
nonviolent civil rights demonstrations, in accordance with Section
519 of Public Law 101-144 (November 9, 1989); and has adopted or will
adopt and implement a policy of enforcing applicable state or local
laws against physically barring entrance to or exit from a facility
or location which is the subject of such nonviolent civil rights
demonstrations within its jurisdiction.
The City of Port Townsend will provide opportunities for citizen
participation comparable to the state's requirements (those described
in Section 104(a)(2)(3) of the Act, as amended~
The City of Port Townsend, when substantial changes are made in the
use of funds, will provide citizens with opportunities to comment~
The City of Port Townsend will not use assessments against properties
owned and occupied by low- and moderate-income persons or charge user
fees to recover the capital costs of CDBG-funded public improvements
from low- and moderate-income owner-occupants;
The City of Port Townsend has complied with all public hearing and
citizen participation requirements and will certify to this
compliance~ the attached Port Townsend Citizen Participation/
Community Development and Housing Plan, appended hereto as
Attachment A, dated July 30, 1991, is hereby adopted and approved~
The City of Port Townsend designates Brent Shirley, as the Authorized
Chief Elected Official and authorized representative to act in all
matters in connection with this application and Port Townsend's
participation in the Washington State CDBG Program; and
Be it further resolved, that based on the representations made by
CAC, all of the tasks required herein will be performed by CAC to the
satisfaction of the State of Washington~ and
Be it further resoslved, that although the City may elect to further
participate with CAC, the provisions of this resolution and
attachments shall not be construed to imply any financial
responsibility or obligation of the City of Port Townsend, nor to
participate in any future gran~l~s~
