A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PORT TOWNSEND
REJECTING THE BID SUBMITTED ON THE CITY'S SECONDARY WASTE WATER
TREATMENT FACILITY BY PK CONTRACTORS, INC.
WHEREAS, in November 1991, the City promulgated the "Contract
Documents for the Construction of Port Townsend Secondary Waste
Water Treatment Facility" and requested bids from contractors on
that project pursuant to RCW 35.23.352; and
WHEREAS, a request for bids on this project has been circulated
and published in the manner required by law; and
WHEREAS, sealed bids for the project were submitted by fourteen
bidders and were opened on January 15, 1992; and
WHEREAS, at the time the sealed bids were opened, the bid
submitted by PK Contractors, Inc., of Spokane, Washington, in the
amount of $6,222,591 was thought to be the lowest bid submitted
on the project, but further analysis of PK's bid documents
reveals that it was not responsive to the bidding instructions;
NOW THEREFORE
Be it resolved by the City Council of the City of Port Townsend
as follows:
Section 1. The bid submitted by PK Contractors, Inc., for the
construction of the Port Townsend Secondary Waste Water Treatment
Facility is hereby rejected by the City pursuant to RCW
35.23.352, for the reason that the bid is not responsive to the
contract documents and bidding instructions previously
promulgated by the City.
Section 2. The bid submitted by PK Contractors, Inc., was found
not responsive for the following reasons:
a. Contrary to the explicit instructions contained in the
bidding instructions, PK failed to provide separate bids for
the acquisition and installation costs for each of the named
alternatives for the owner-selected equipment items.
Instead, PK provided bids for only one manufacturer for each
item of equipment.
b. PK failed to include any bid for the generator set, a
major item of equipment called for under the bidding
documents, which would cost in excess of $50,000. This
omission has raised the question of whether the cost of such
equipment was in fact included in PK's lump sum bid.
c. Contrary to the bidding instructions, PK failed to
submit a letter or other information by which PK agreed that
the supplied equipment would conform to specifications
already submitted by the manufacturers of such equipment.
d. Contrary to the bidding instructions, PK failed to
return all of the required contract forms, which were
contained in the contract documents delivered to each
bidder.
ADOPTED by the City Council of the City of Port Townsend and
