A RESOLUTION OF THE CITY COUNCIL FOR THE CITY OF PORT
TOWNSEND DECLARING AN EMERGENCY AND AUTHORIZING THE
MAYOR TO DISPENSE WITH THE NORMAL BIDDING PROCEDURES
AND CONTRACT FOR CONSTRUCTION OF A FENCE AT THE MORGAN
HILL RESERVOIR AS SOON AS POSSIBLE TO AVOID ADDITIONAL
INCIDENTS OF VANDALISM AND PROVIDE FOR PUBLIC SAFETY.
WHEREAS, within the last several days vandals have trespassed upon the grounds of the
Morgan Hill Reservoir site and have broken into a valve shed and opened valves resulting in the
filling of a portion of the empty reservoir creating a substantial loss of valuable drinking water
and creating a substantial danger to public safety; and
WHEREAS, the fence previously existing at the reservoir site had fallen into disrepair
and was no longer providing a barrier to entry to the site and had to be removed; and
WHEREAS, there have been several recent incidents of trespass at the reservoir site by
children which required the intervention of law enforcement personnel and endangered the
children; and
WHEREAS, the City of Port Townsend is responsible for providing protection of a safe
water supply and for the safety of its citizens from hazards such as the open reservoir; and
WHEREAS, it is likely that the vandalism and risk to public safety will continue and
perhaps worsen if the current pattern of illegal activity at the site is allowed to continue without
the placement of a security fence of a permanent nature; and
WHEREAS, use of the normal public bidding procedure would delay installation of an
adequate security fence at the site for several additional months and would allow the existing
hazardous situation to continue unabated; and
WHEREAS, state statutes allow the normal public bidding process to be dispensed with
in the event of an emergency to avoid the potential of imminent harm to the public; Now,
Therefore,
Be it resolved by the City Council for the City of Port Townsend that an emergency
situation exists from the lack of a security fence existing at the Morgan Hill Reservoir site and
the Mayor is authorized to contract for the immediate construction of a permanent security fence
at the Morgan Hill Reservoir site by obtaining telephone or in-person quotes from at least three
suppliers and contracting with the vendor which can provide the fence at the earliest opportunity
and, if more than one of the vendors can install the fence immediately, contracting with the
vendor able immediately to do the work at the lowest price.
Adopted by the City CounCil for the City of Port__ned by the Mayor this
15th day of November, 1993.
