HomeMy WebLinkAbout94-038RESOLUTION NO. qq'"~8' A RESOLUTION AUTHORIZING THE MAYOR TO EXECUTE AN AMENDMENT TO THE PLANNED UNIT DEVELOPMENT AGREEMENT FOR TOWNE POINT ALLOWING A COMBINED CLUBHOUSE AND MANAGEMENT OFFICE, ELIMINATION OF THE REQUIREMENT FOR A SEPARATE MANAGEMENT OFFICE AND A REDUCTION IN THE REQUIRED NUMBER OF TENNIS COURTS FROM THREE COURTS TO ONE COURT. WHEREAS, the Towne Point development is the subject of a Planned Unit Development Agreement with the City which contains certain requirements regarding facilities provided as amenities at the development; and WHEREAS, the owners of Towne Point have provided security in the form of a Deed of Trust on a separate parcel of land which is to be released upon completion of the required improvements in the Planned Unit Development of Towne Point; and WHEREAS, the homeowner's association for Towne Point has voluntarily amended the declaration of covenants, conditions and restrictions for the development to allow a combined clubhouse/management office to be provided, the elimination of a separate management office and a reduction in the required number of tennis courts from three courts to one court; and WHEREAS, in light of the desire of both the project developer and the homeowner's association for the development that the required facilities be modified as provided in the original Planned Unit Development Agreement, Now, Therefore, BE IT RESOLVED BY THE CITY COUNCIL FOR THE CITY OF PORT TOWNSEND: The Mayor is hereby authorized to execute an amended Planned Unit Development Agreement for the Towne Point development which authorizes construction of a combined clubhouse/management office, deletion of the requirement of a separate management office and a reduction in the number of tennis courts from three courts to one court. 1994.
