HomeMy WebLinkAbout95-005 8 . . - Resolution No. 9~ - 05""" A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PORT TOWNSEND DECLARING CERTAIN TIMBER TO BE SURPLUS PROPERTY , WHEREAS, certain timber on city property at City Lake is susceptible to laminated root rot, a disease which makes it easily windblown and a hazard and therefore a threat to the City's water disinfection facilities at City Lake; and WHEREAS, the Public Works Department has filed and received approval of a forest practice application with the Department of Natural Resources for logging the timber at City Lake; and WHEREAS, other salvage timber, defined as timber which is diseased, fire damaged, windblown or infested by insects or fungus, on city properties near Lords Lake and Snow Creek, is or may become a threat to public health and safety, and surrounding timber; and WHEREAS, lands or property originally acquired for public utility purposes which is determined to be surplus may be sold pursuant to RCW 35,94.040, NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Port Townsend: I. The City Council determines that diseased and/or windblown trees around the City's chlorination facilities at City Lake is surplus to the City's needs and that such salvage timber is not required for providing continued public utility service, and may logged and sold. 2. The City Council determi~es that salvage timber around city property at Lords Lake and Snow Creek is surplus to the City's needs and that such salvage timber is not required for continued public utility service, and may be logged and sold, 3. The City Council recognizes that the market for timber is a fluctuating market, and that the fair market value for timber depends on the type and condition of the trees. Therefore, the City Council sets a minimum fair market value for salvage timber on the identified city properties at $40 per ton or $400 per 1,000-board feet. The Public Works Director, or his or her designee, is directed to sell such salvage timber based on the fair market value existing at the time of sale for the particular type and condition of the trees, but for no less than this minimum amount. Res: Timber Surplus Properly 8 . 4, The City Council further deems that it is in the best public interest for the following terms and conditions to apply to the disposition of the surplus timber: a. As an alternate method limited to the small scale sale of timber on city property, salvage timber on the identified city properties may be sold by the Public Works Department to a small mill operation which will log and load the trees, mill them and retain half the timber and sell the other half for the City, provided that this method of selling the trees yields the City approximately the same fair market value set forth in paragraph 3 above. b. An y area logged shall be revegetated as necessary. c. Where required by state law, the Public Works Director, or his or her designee, shall make a forest practice application and receive Department of Natural Resources approval prior to any logging.
