RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PORT
TOWNSEND APPROVING SECOND AMENDMENT TO INTERLOCAL
GOVERNMENT AGREEMENT BETWEEN PORT TOWNSEND AND
JEFFERSON COUNTY FOR BIOSOLIDS COMPOSTING FACILITY,
AUTHORIZING ACCEPTANCE OF SEPTAGE FROM SOURCES
OUTSIDE JEFFERSON COUNTY
The City Council of the City of Port Townsend, Washington, does resolve as follows:
WHEREAS, on October 8, 1992, the City of Port Townsend and Jefferson County
signed an Interlocal Agreement allowing the City to construct and operate a biosolids and yard
waste composting facility within the site of the Jefferson County Landfill; and
WHEREAS, pursuant to the 1992 Agreement, the City agreed to accept septage from
Jefferson County at the composting facility, limiting septage accepted at the facility to that
collected from the residents within Port Townsend and Jefferson County; and
WHEREAS, the City's biosolids facility is designed to handle a capacity of 20,000
gallons of septage per week; and
WHEREAS, the City typically receives deliveries of less than 5,000 gallons per week
from residents of Port Townsend and Jefferson County; and
WHEREAS, the biosolids composting facility is currently operating under a temporary
State of Washington Waste Discharge to Land Permit, No. 6127, issued by the Department of
Ecology; and
WHEREAS, prior to the permanent approval of the Department of Ecology Discharge
Permit, No. 6127, the City must demonstrate comprehensive testing, data acquisition, and
review of operations of the biosolids composting facility, which objective cannot be met with
the current supply of septage far below the expected supply and design capacity; and
WHEREAS, the City and Jefferson County have mutually negotiated a Second
Amendment to the Interlocal Agreement, allowing acceptance of septage from sources outside
of Jefferson County, so long as the septage originating from outside Jefferson County does not
exceed the design capacity of 20,000 gallons per week, and so long as the City continues to
accord priority to septage originating from within Jefferson County,
NOW, THEREFORE, BE IT RESOLVED, that the City Council for the City of Port
Townsend agrees to amend the October 8, 1992 Interlocal Agreement with Jefferson County,
to allow acceptance of septage from sources outside Jefferson County, pursuant to the proposed
Second Amendment to Interlocal Agreement. The Council authorizes the Mayor to sign the
Second Amendment to Interlocal Agreement in substantially the form attached to this resolution.
