RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PORT
TOWNSEND DECLARING AN EMERGENCY AND WAIVING PUBLIC
BIDDING REQUIREMENTS
The City Council of the City of Port Townsend, Washington, does resolve as follows:
and
WHEREAS, the City is engaged in a public works project improving San Juan Avenue;
WHEREAS, the City has endeavored to have walkway (expanded roadway shoulder)
improvements along San Juan Avenue completed prior to the scheduled opening of the new Blue
Heron Middle School; and
WHEREAS, the San Juan Avenue improvement project has been an accelerated project,
with an accelerated need by the City to explore all available local and state funding resources;
and
WHEREAS, state grant funding was not received for the San Juan Avenue project until
relatively recently, and state property appraisals were not authorized until July 31, 1995, with
confirming appraisals for all property acquisitions required thereafter; and
WHEREAS, it has been necessary to re-design the project (as preliminarily proposed)
to better fit within local and state funding resources; and
WHEREAS, the City intends to bid the overall San Juan Avenue improvements, in
compliance with state law; and
WHEREAS, as a consequence of a very limited time frame for construction of the
sidewalk and expanded roadway shoulder improvements prior to the opening of Blue Heron
Middle School, it is impossible for the City to complete public bidding for the entire public
works project, including interim sidewalk, walkway and roadway shoulder improvements; and
WHEREAS, City Public Works crews are capable of completing interim sidewalk,
walkway and expanded roadway shoulder improvements as described below, for a cost to the
City of approximately $20,000; and
WHEREAS, there is an imperative need that the interim sidewalk improvements be
completed prior to the opening of Blue Heron Middle School,
NOW, THEREFORE, BE IT RESOLVED, by the City Council for the City of Port
Townsend as follows:
1. The City declares that completion of interim sidewalk, walkway and expanded
roadway shoulder improvements defined within this Resolution is an imperative need,
required prior to the opening of the new Blue Heron Middle School.
2. Adequate pedestrian circulation available for children attending the new Blue
Heron Middle School is a public need, which cannot be delayed to fulfill public bidding
requirements for the overall project. The City Council declares an emergency to exist
in immediately providing these interim improvements.
3. The City Council hereby authorizes the City Public Works Department to perform
the following interim sidewalk, walkway, and roadway shoulder expansion improvements
without engaging in public bid procedures:
a. Clearing and grading to provide a gravel base for a temporary sidewalk
along the east side of San Juan Avenue from F Street to Admiralty Street; and
b. Gravel sidewalk improvements along the west side of San Juan Avenue
from the south entrance of the school to F Street; and
c. A trail segment between Haines Street and Umatilla Street to Alder and
Umatilla Street, then south up Alder Street to 30th Street; and
d. A trail segment from the northern side of the school property to the
northwest portion of the school property.
4. The City Council requires the immediate execution of the public work defined in
paragraph 3 above, and directs that such public work be done immediately by City work
crews.
5. Pursuant to authority conferred by State Law, the City hereby waives public bid
requirements for these interim improvements. Notwithstanding this waiver, all future
work undertaken on the San Juan Avenue improvement project shall be in compliance
with public bidding procedures pursuant to State Law.
6. The City Council hereby validates and approves all action by the Public Works
Department consistent with this Resolution conducted >rior to the date of this Resolution.
