A RESOLUTION authorizing the Mayor to enter into a Property Use and
Development Agreement in implementation of the Hamilton Heights Planned
Unit Development.
WHEREAS, McBride Properties, Inc. and Vantage Properties, Inc. have petitioned the City
in accordance with Chapter 17.40 of the Port Townsend Municipal Code to develop as a
Planned Unit Development certain property described in Planned Unit Development
Application No. 9409-05; and
WHEREAS, the City Council has reviewed and approved the petition of McBride Properties,
Inc. and Vantage Properties, Inc. for preliminary plat and Planned Unit Development approval
and has adopted findings of fact and conclusions dated December 18, 1995; and
WHEREAS, certain conditions are necessary and proper to assure development of the Planned
Unit Development in compliance with accepted principles of land use planning, and the
requirements of Chapter 17.40, and to mitigate probable adverse impacts under the State
Environmental Policy Act (SEPA); and
WHEREAS, McBride Properties, Inc., and Vantage Properties, Inc., as a free and voluntary
act have agreed to the conditions proposed by the City and all parties wish to memorialize
their agreement through this document;
Now Therefore,
BE IT RESOLVED by the City Council of the City of Port Townsend that the Mayor is
hereby authorized on behalf of the city to enter into a Property Use and Development
Agreement, substantially in the form attached hereto and contingent upon obtaining all
signatures of the owner's in fee simple and all those having interest in the property.
ADOPTED by~ Coltgcil of the City of Port Townsend in regular session assembled
