RESOLUTION NO. 24-031
A RESOLUTION DECLARING AN EMERGENCY, WAIVING PUBLIC BIDDING
REQUIREMENTS, AND RATIFYING THE CITY MANAGER'S APPROVAL OF ALL
APPLICABLE DOCUMENTS TO ALLOW FOR THE IMMEDIATE REPAIR OF
DAMAGE TO SEWER AND TRANSPORTATION INFRASTRUCTURE
WHEREAS, Section 3.46.090(E) of the City of Port Townsend Municipal Code
(PTMC) and Section 39.04.280(1)(C) of the Revised Code of Washington (RCW) allow
exemptions to competitive bidding requirements under emergency conditions; and
WHEREAS, RCW 39.04.280(3) defines "emergency" as unforeseen circumstances
beyond the city's control, that either presents a real, immediate threat to the proper
performance of essential functions, or will likely result in material loss or damage to property,
bodily injury, or loss of life if immediate action is not taken; and
WHEREAS, on August 31, 2024, a sewer line collapse occurred on Sims Way/SR20
near the WSDOT Ferry Terminal; and
WHEREAS, on August 31, 2024, City staff inspected and found a sinkhole and
damage caused by the sewer line collapse; and
WHEREAS, the City Manager has determined that the damage described herein
constitutes an emergency, as defined in RCW 39.04.280(3), based on the need to immediately
repair the sewer and transportation infrastructure and mitigate effects on public facilities, to
ensure the proper performance of essential functions, prevent further damage to property, and
further public safety goals; and
WHEREAS, PTMC Section 3.46.090(E)(3) requires the City Council to concur with the
City Manager's declaration of emergency by passage of a resolution declaring the emergency,
reciting the facts constituting the emergency, and waiving the public bidding requirements; and
WHEREAS, for the reasons stated herein, the City Council find that it is the best interest
of the City to declare an emergency, waive public bidding requirements for the public work to be
undertaken, and authorize the execution of all necessary documents required in order to initiate
repairs to the sewer and transportation infrastructure,
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Port
Townsend, Washington, as follows:
Section 1. The recitals above are hereby adopted by reference as the City's findings in
support of the emergency declaration, as if fully set forth herein.
Section 2. The City Council hereby declares an emergency justifying the waiver of
certain contracting processes, including public bidding requirements.
Section 3. All prior actions taken in conformance with this resolution, including the
actions of the City Manager and the Public Works Director, as described in their Memorandum
dated August 31, 2024, are hereby ratified and confirmed.

Subject: Emergency Repair to Sewer Line on 8/31/24
The purpose of this memo is to provide background information for the City Manager and City Council in
support of an emergency declaration. This declaration allows for expedient contracting to facilitate
restoration of the failed infrastructure. The damage discovered on 8/31/24 and caused by a failing
sewer line on SR20/Sims Way requires immediate repair to prevent further damage, disruptions to
public use, and potential safety concerns. Both engineering and construction work is necessary and
underway to remedy the issues as described as follows. Luckily, we have a head start as this section of
pipe is with the scope of the larger Water Street Sewer Replacement project funded by the Public Works
Board and already 90% designed.
As you may recall, this is the same pipeline where we experience a similar failure near the Gaines Street
lift station. That emergency repair led to investigation that demonstrated the entire pipe between the
Ferry Terminal and Gaines Street is in jeopardy of failure. This led to securing $2.7 million in grant and
loan funding to support the project. Design work has been underway since the funds were authorized in
September of 2023.
Description:
Location — Sims Way/SR20 adjacent to the WSDOT Ferry Terminal
During the morning of 8/31/24, Chan Hettle (on call) received a report that a sinkhole was starting to
form. We understand the report was initially made by Jefferson Transit. Crews were on -scene at
12:30am and began to investigate. Crews started jackhammering the pavement after mobilizing
equipment in the early morning hours. Crews found the pavement was undermined and would easily
collapse with a heavy vehicle. The cause of the sink hole was determined to be a failed sewer line which
is part of the forcemain pipe system from the Monroe Street Lift Station serving all of Downtown,
Uptown and Morgan Hill.
Included by reference are images that show the extent of the problem and work that needs to be done.

Remedy:
Staff has reached out to local contractors for assistance in the repair. Seton Construction responded
with crews and equipment first thing Saturday morning.
Given the failure and based on the attempt to remedy the failed pipe, staff is recommending proceeding
with replacement of nearly 300 feet of sewer forcemain. This work was already planned and this will
accelerate the remedy. This work is expected to take this 3-5 days with a goal of completing the work in
advance of Wooden Boat Festival.
After -the -fact permits will be required to satisfy any shoreline or critical areas requirements including
notification of surrounding property owners. This memo is supplemental to the emergency declaration
that was made by City Manager Mauro at approximately 8:00 a.m. Saturday morning 8/31/24.
