RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PORT
TOWNSEND APPROVING PORT TOWNSEND SWIM TEAM POOL USE
AGREEMENT FROM JULY 1, 1997 THROUGH JUNE 30, 1998
The City Council of the City of Port Townsend, Washington, does resolve as follows:
WHEREAS, the Port Townsend Swim Team CPTST") (formerly the Jefferson County
Swim Association), a Washington non-profit corporation, desires to use the Port Townsend
swimming pool facilities, located at Mountain View Elementary School Cthe Pool") each week,
for a prescribed number of hours; and
WHEREAS, the Pool is owned by the Port Townsend School District but is under the
control and management authority of the City; and
WHEREAS, the City has been making the Pool available to PTST for the past year, in
exchange for a reasonable monthly use fee to reimburse the City for management and lifeguard
needs and services required for the PTST use of the Pool, and the City and PTST desire to
continue this arrangement; and
WHF. JIEAS, the City and PTST entered into a Pool Use Agreement, dated July 1, 1996,
approved by Resolution No. 96-99, which Agreement the parties wish to terminate and replace
with a new Agreement based on re-negotiated terms; and
WHEREAS, PTST has agreed to pay an average of $450.00 per month as a reasonable
fee for the use of the Pool, to defray the City's costs associated with Pool management during the
PTST hours of use and staffing; and
WttERE~, the hours of use will continue to be from Monday through Friday, generally
during the hours of 2:30 p.m. to 5:00 p.m., subject to some variation in hours depending on the
season in order to better reflect actual usage throughout the year; and
WHEREAS, the Parks, Recreation and Property Committee has considered the new
Agreement and has recommended that it be approved; and
WHEREAS, the Parks, Recreation and Property Committee has further recommended that
the Public Works Director be authorized to negotiate minor revisions (such as changes to the fee
or pool use schedules) to the Agreement without bringing the Agreement back to the full Council,
NOW, THEREFOr, BE IT RESOLVED, by the City Council for the City of Port
Townsend that:
(1) The mayor is hereby authorized to sign the Port Townsend SWim Team Pool Use
Agreement in substantially the same form as attached; and
(2) The Public Works Director is hereby authorized to negotiate extensions to the
Agreement term and/or minor changes to the Agreement and to sign any amended Agreement on
behalf of the City; major changes must still be brought to the full Council for consideration and
approval.
ADOPTED by the City Council of the City of Port Townsend and signed by the Mayor
on this 16th day of June, 1997.
