A RESOLUTION APPROVING THE SECOND AMENDMENT
TO THE PROPERTY USE AND DEVELOPMENT AGREEMENT
FOR THE HAMILTON HEIGHTS PLANNED UNIT DEVELOPMENT
WHEREAS, the City and Hamilton Heights L.L.C. entered into a certain Property Use and
Development Agreement for the Hamilton Heights Planned Unit Development on
November 15, 1996; and
WHEREAS, an amendment to the PUDA was approved by City Council on June 16, 1997,
altering phasing of construction to allow three phases where two phases were originally approved;
and
WHEREAS, Mr. Ken Forssen, acting as an agent of the Hamilton Heights L.L.C. has requested a
second amendment to replace PUDA condition #17f relating to improvements to the intersection
of Hastings Avenue and Howard Street, to replace condition #78 concerning operation and
maintenance of the sewer station, and to add a new condition that allows future amendments to
follow the procedural provisions of Chapters 20.01 and 17.32 of the Port Townsend Municipal
Code; and
WHEREAS, the Planning Commission has concluded that the proposed amendment does not
constitute a substantial alteration of the original plan and City Council has accepted the Planning
Commission's recommendation.
NOW THEREFORE, City Council hereby accepts and adopts the findings of fact, conclusions
and project conditions as recommended by the Planning Commission dated January 8, 1998, and
authorizes the Mayor to sign the Second Amendment to the Hamilton Heights PUDA in
substantially the form attached hereto.
ADOPTED by the City Council of the City of Port Townsend in regular session assembled this
20 day of January, 1998.
