WHEREAS, the 1972 Environmental Protection Agency law, commonly known as the Clean
Water Act,gave the EPA authority to implement pollution control programs such as setting
wastewater standards;
WHEREAS, municipalities are mandated by law to build, maintain, and plan for upgrades to all
wastewater facilities, sewer systems, and adjacent systems,so that sewage and wastewater from
homes, businesses, and industries are treated before being discharged to bodies of water;
WHEREAS, the City of Port Townsend built the Wastewater Treatment and Compost facilities
in 1993 to provide vital and mandatory sewage treatment for the health and safety of residents in the
City and our environment;
WHEREAS, the Port Townsend Wastewater Treatment facility is an enterprise that is self-
sustaining and invested in by theapproximately 5,000 rate payer accounts who are resident
households& businesses in Port Townsend;
WHEREAS, The City maintains a collection system of more than 77 miles of sanitary sewer
pipe, 120 maintenanceholes, 6 lift stations, and 3 emergency generators;
WHEREAS, the Port Townsend Wastewater Treatment and Compost Facilitieshave been in
continuous operation, 24 hours a day, 7 days a week for 30 years;
WHEREAS, the City values the staff who have worked their entire careers at our wastewater
treatment facilities, for their commitment to the knowledge and skill needed in operating this vital
infrastructure- their expertise, planning, and hard work benefits all of us and protects water quality
every day;
WHEREAS, the Port Townsend Wastewater Treatment facility has been award-winning since
its inception and is now the first recipient of the 25 Years of Outstanding Performance Award from the
Washington State Department of Ecology;
NOW, THEREFORE, l, David J. Faber, Mayor of the City of Port Townsend, declare Monday,
December 4, 2023, to be
Wastewater Treatment Day
in the City of Port Townsend and encourage all residents to celebrate the essential role of wastewater
treatment to our community’shealth,safety, and environmental wellbeing.

SUMMARY STATEMENT:
The City Attorney is taking unexpected family medical leave for the next 1-3 months.
The organization therefore requires on-call services of a municipal attorney to ensure
we meet statutory requirements and that workflow and operations continue as smoothly
as possible. After preliminary discussions with our City Attorney and MRSC, the firm
Kenyon Disend, PLLC, was identified and I engaged an attorney with interest and
capacity to serve immediately.
PTMC 3.46.110(A)(2) permits the City Manager to sign a contract up to $25,000 “if the
contract is time-sensitive and delay in bringing the matter before council would cost the
city time and money.” While this is the current case, including the item in consent for
Council approval is an extra check on process.

SUMMARY STATEMENT:
The City has prioritized staff engagement over the past three years. As part of
discussions on appropriating ARPA funding, Council agreed to fund an organization-
wide engagement initiative in last year’s budget. Due to turnover of the former People
and Performance Director, this initiative was stalled. Now with a new Director at the
helm, HR has researched best practice approaches for organizational engagement and
wishes to proceed with Gallup, Inc. on a year-long initiative that includes training and
development for management staff, engagement surveys will all City staff, and data-
informed decision-making to ensure the City of Port Townsend is on a clear trajectory to
continue to attract and retain quality, engaged, and productive staff.

SUMMARY STATEMENT:
Recruitment for the key position of City Engineer/Deputy Public Works Director has
been a challenge for well over a year. Staff have tried multiple approaches and have
not successfully secured a candidate for the position or even many interested
candidates. HR and Public Works have met with the Preston Recruitment Group and
believe their approach and focus on recruitment for this key position is likely to yield a
positive result.

SUMMARY STATEMENT:
The legislative body must hold a public hearing on the proposed budget and the
revenue sources to support the operating and capital expenditures for the coming year.
Opportunity is given to receive public testimony on the proposed budget and its
revenues sources through the process of opening and closing the first public hearing on
this matter. The final public hearing on the 2024 budget and revenue sources will occur
on December 4, 2023, with final adoption anticipated on December 4, 2023.
The City Manager’s Proposed 2024 Budget is presented for Council discussion and
deliberation. At this time, it is recommended that consideration is taken for public or
Councilmember input and provide direction to staff about making any adjustments.

ORDINANCE NO.3325
AN ORDINANCE ADOPTING THE BUDGET FOR THE CITY OF PORT
TOWNSEND, WASHINGTON, FOR THE FISCAL YEAR
ENDING DECEMBER 31, 2024
WHEREAS, the City Manager of the City of Port Townsend, Washington, completed
and placed on file with the City Clerk a proposed budget and estimate of the amount of monies
required to meet the public expenses, bond retirement and interest, reserve funds and expenses of
government of the City for the fiscal year ending December 31, 2024 (the “2024 Preliminary
Budget”), and a notice was published that the City Council would conduct a public hearing on
th
the 20of November 2023at 6:00 p.m., at City Hall for the purpose of receiving public
testimony regarding the preliminary budget for the 2024 fiscal year; and
WHEREAS, the City Council held a public hearing on November 20, 2023 at which all
taxpayers were heard who appeared for or against any part of the preliminary budget; and
WHEREAS, following the public hearing, the City Council met in City Council
Chambers on December 4, 2023 to consider the 2024Final Budget and receive further public
comment, and made adoptions and changes, as it deemed necessary and proper; and
WHEREAS, the 2024 Budget does not exceed the lawful limit of taxation allowed by
law to be levied on the property within the City of Port Townsend for the purposes set forth in
the 2024 Final Budget, and the estimated expenditures in each fund set forth in the 2024 Final
Budget are all necessary to carry on the government of the City for fiscal year 2024, and are all
necessary to meet the various needs of the City during the period;
NOW, THEREFORE, the City Council of the City of Port Townsend, Washington, do
ordain as follows:
Section 1.The budget for the City of Port Townsend, Washington, for the fiscal year
2024, is hereby adopted at the fund level as set forth in the document entitled “City of Port
Townsend Final Budget 2024,” a copy of which has been and now is on file with the office of
the City Clerk, and by this reference is incorporated into this Ordinance.
Section 2. Estimated revenues, including fund balances for working capital for each
separate fund of the City of Port Townsend, and aggregate totals for all such funds combined, for
the year 2024, are set forth in summary form in Exhibit A attached, and by this reference are
incorporated in this Ordinance, and are appropriated for expenditure at the fund level during the
2024budget year.
Section 3.The City Clerk is directed to transmit a certified copy of the City of Port
Townsend Final Budget 2024 to the Office of State Auditor and to the Association of
Washington Cities.

SUMMARY STATEMENT:
City Council voted to approve the first reading of Ordinance 3326 Related to Public
Utility Taxes and Amending Port Townsend Municipal Code Section 5.84.030. Tonight
offers the second reading and review of the proposed ordinance.
The City imposes a 18% tax on the revenues of the City’s storm and surface water,
water system, and sewer utilities. 1.5% of that tax will sunset on December 31, 2023.
The City also imposes a 22% utility tax on the revenues of the City’s solid waste utility.
2% of that tax will sunset on December 31, 2023.
Public utility taxes are part of the general revenues to the City. In the 2015 Council
meeting minutes, when the additional 1.5% public utility tax was added, it was outlined
that the additional funding would be used to support streets, parks, and facilities. The
recommendation from the Finance & Budget Committee is to continue with the 18%
public utility tax on the revenues of the City’s storm and surface water, water system
and sewer utilities. The recommendation is to also continue the 22% utility tax on the
revenues of the City’s solid waste utility. In addition, the recommendation is to use the
full public utility tax to support all the general services of the City. This creates one big
bucket, allowing broader use and greater flexibility without creating limitations and
complexity. The 2024 budget was balanced based on the continuation of the public
utility tax at its current levels.

AN ORDINANCE OF THE CITY OF PORT TOWNSEND RELATED TO PUBLIC
UTILITY TAXES ANDAMENDING PORT TOWNSEND MUNICIPAL CODE
SECTION5.84.030
RECITALS
1. The City of Port Townsend imposes a 18% utility tax on the revenues of the City’s storm and
surface water, water system, and sewer utilities. 1.5% of the utility tax will sunset on December
31, 2023.
2. The City of Port Townsend imposes a 22% utility tax on the revenues of the City’s solid waste
utility. 2% of that utility tax will sunset on December 31, 2023.
3. In order to maintain the current level of City’s services, the City will extend indefinitelythese
additional percent tax.until December 31, 2025.
NOW THEREFORE, the City Council of the City of Port Townsend do ordain as follows:
Section 1. Amendment. Sections 5.84.030(G) of the Port Townsend Municipal Code are
amended as follows:
G. Effective April 1, 2022, through December 31, 2023 there is levied a fee or tax equal to 18
percent on the gross revenues of the following utilities:
1. The city’s storm and surface water utility established under Chapter 13.31 PTMC;
2. The city’s water system established as provided in Chapters 13.11 through 13.17 PTMC
(the “water code”); and
3. The city’s sewer system established as provided in Chapters 13.21 through 13.24 PTMC
(the “sewer code”).
Effective January 1, 2024, the fee or tax shall revert to 16.5 percent.
Funds shall be allocated as follows:
a. Revenues from first eight and one-quarter percent and from the temporary one and
one-half percent: general fund services;
b. Revenues from second eight and one-quarter percent (amount collected in excess of
the first eight and one-quarter percent): 85 percent to street fund and 15 percent to public
safety.
The capital surcharge component of the water, sewer, and storm and surface water rates is
excluded from the city’s utility tax.

Contracted raw water sale revenue to Olympic Gravity Water System customers may be
excluded from the city’s utility tax if the contract provides a reasonable administrative fee per
Chapter 13.18 PTMC.
Section 2. Amendment. Sections 5.84.030(H) of the Port Townsend Municipal Code are
amended as follows:
H. Effective January 1, 2019, through December 31, 2023, there is levied upon, and there shall
be collected from, the city’s solid waste or garbage utility a fee or tax equal to 22 percent of the
gross revenues of such utility established pursuant to Ordinance No. 1366 for the purposes as
provided in Chapter 6.04 PTMC. Effective January 1, 2024, the fee or tax shall revert to 20
percent.The tax shallappear and be separately itemized on the monthly bill of each retail
customer of the solid waste or garbage utility. Funds shall be allocated as follows:
1. Revenues from first 10 percent and the temporary two percent: general fund services;
2. Revenue from second 10 percent (amount collected in excess of the first 10 percent):
85 percent to street fund and 15 percent to public safety
Section 3. Severability. If any provision of this ordinance or its application to any person or
circumstance is held invalid, the remainder of the ordinance, or the application of the provision
to other persons or circumstances is not affected.
Section 4. Effective Date. This ordinance shall take effect and be in force five days after the
date of its publication in the manner provided by law.
ADOPTED by the City Council of the City of Port Townsend, Washington, at a regular

The 2 half of the year is the 2 opportunity to review funds, projects, and expenditures
that were not included in the adopted budget. Supplemental appropriations are required
to provide the needed resources to support operations and capital projects.
There are many reasons why supplemental appropriations are needed.
The timing of expenses across budget years requires the spending authority to be
carried forward.
Additional expenditures emerge as new information or activity occurs that was not
previously known or available when compiling the current year budget.
Increased costs due to supply chain issues, labor shortages and inflation factors.
Unforeseen emergencies.
Obtaining legislative authority for the proper management of funds in the general
ledger.

The 2 budget supplemental appropriation request coversthe remainder of 2023. The
items presented have been brought before Council in other actions through out the year.

2 Budget Supplemental Requests include:
Consultants utilized for permit fee study and housing needs assessment.
Contractor work and projects include Evans Vista clean up, Pool roof repair,
Mountain View campus pool assessment and golf course project.
Operating expenses for supplies, small projects and repairs include City Hall fire
system inspection corrections, Street asphalt repairs and striping, replacement of
utility pumps, engineering development review, training, engineering costs and the
purchase of activated carbon.
Capital projects underway include Kearney Street, Cherry Street, Discovery Road,
OGWS Meters, Land Purchase and Water Street repair design.
Machinery and equipment purchase include a F250 diesel truck, Boring
Equipment, and the Little Quil meter replacement.
Grants include 2 pass-through grants from All Washington Cities (AWC) under the
Community Assistance Resources and Extended Services Program (CARES).
The first grant was in the amount of $217,000 and covered reimbursable costs in
2023. The second grant is for $260,000 and will cover reimbursable costs from
July 1, 2023 – June 30, 2024.
Transfer and expenditure authority from various funding sources to cover the
project and equipment work done across the organization.

ordinance ispresented on December 4,2023. A request is made to waive the second
reading and approve the supplemental budget as presented.

AN ORDINANCE OF THE CITY OF PORT TOWNSEND, WASHINGTON, ADOPTING
2023 SUPPLEMENTAL #2 BUDGET APPROPRIATIONS
WHEREAS,the City Council adopted a supplemental budget per Ordinance 3310on
May 1, 2023and was set forth in the document entitled “City of Port Townsend Budget 2023
Supplemental #1 Fund Detail”; and
WHEREAS, the City Manager of the City of Port Townsend, Washington completed and
filed an additional proposed supplemental budget for 2023 on December 4, 2023, and
WHEREAS, the City Council reviewed the second supplemental budget on December 4,
2023;
NOW, THEREFORE, the City Council of the City of Port Townsend, Washington, do
ordain as follows:
Section 1. The second supplemental budget for the City of Port Townsend, Washington,
for the fiscal year 2023, is adopted as set forth in the document entitled “City of Port Townsend
Budget 2023 Supplemental #2 Fund Summary,” a copy of which is on file with the office of the
City Clerk and is incorporated into this Ordinance. The budget supplemental #2 summary is
attached as Exhibit A making revenue and expenditure revisions.
Section 2. This Ordinance shall take effect upon its passage, approval, and publication
in the form and manner provided by law.
