HomeMy WebLinkAbout23-003 Adopting a Material Change PolicyResolution 23-003 RESOLUTION NO. 23-003 A RESOLUTION OF THE GOVERNING BODY OF THE PORT TOWNSEND TRANSPORTATION BENEFIT DISTRICT OF THE CITY OF PORT TOWNSEND ADOPTING A MATERIAL CHANGE POLICY WHEREAS, the City of Port Townsend approved Ordinance No. 3319 on July 24, 2023 establishing the Port Townsend Transportation Benefit District of the City of Port Townsend pursuant to Chapter 36.73 R.CW; and WHEREAS, RCW 36.73.160 requires the Transportation Benefit District to adopt a material change policy to address major plan changes that affect project deliver or ability to finance the plan and address material changes to cost, scope, and schedule; the level of change that will require governing body involvement; NOW, "THEREFORE, BE IT RESOLVED by the Governing Board of the Port Townsend Transportation Benefit District as follows: Section 1 - Material Cham -ye to Cost. In the event an approved transportation improvement project exceeds its original cost by more than twenty percent (20%), the Board shall hold a public hearing to solicit comments from the public regarding how the cost change should be resolved. TBD staff shall consult with the Board Chair prior to setting the public hearing. Section 2 - MN41aq,qrijq1 Change to In the event that the scope of a transportation improvement project materially changes from that originally anticipated at project approval, TBD staff shall consult with and review the changes with the Board Chair. The Board Chair shall determine whether or not to convene a meeting of the Board for discussion. If the scope of the change will result in an increase in cost by more than twenty percent (20%), the Board shall hold a public hearing to solicit comments from the public regarding how the change of scope should be resolved. In the event that the schedule of a transportation improvement project materially changes in a way that significantly impacts other TBD projects for funding, or schedule changes exceed 180 days, TBD staff shall consult with and review such changes with the Board Chair. The Board Chair shall determine whether or not to convene a meeting of the Board for discussion. In the event that the schedule change of a transportation improvement project will result in an increase in cost by more than twenty percent (20%), the Board shall hold a public hearing to solicit comments from the public regarding how the schedule change should be resolved. Section 4 - Definition of Material Change. Material change as used in Sections 2 and 3 above shall be defined as a change, knowledge of which would more likely than not have affected the Board's decision regarding the project. The Board Chair shall have the authority to determine whether material changes have occurred that require a meeting of the Board.
