HomeMy WebLinkAbout98-087Resolution No. 98- ~ ~ '-] RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PORT TOWNSEND APPROVING RELEASE AND EXTINGUISHMENT OF MILLIKEN RESTRICTIVE COVENANT The City Council of the City of Port Townsend, Washington, does resolve as follows: WHEREAS, on November 18, 1996, Therese V. Milliken and Norman F. Milliken recorded a restrictive covenant tying together Lots 6, 7 and 8 of Block 2 in the Broadway Addition to the City of Port Townsend. The covenant was recorded at Jefferson County Auditor's File No. 396224, for the purpose of enabling the City to issue permits for construction of an outbuilding accessory to a primary residence, and extending water and sewer service from the main residence to the accessory building. The restrictive covenant provided that the covenant could not be removed unless approved by the City Council; and WHEREAS, the Millikens have now connected the accessory building to separate water and sewer service meters and have paid system development charges for the connections. The building is no longer "accessory" to the original residence on the property. The Millikens wish to sell the previously accessory building on the property, but cannot do so unless the covenant is extinguished; and WHEREAS, the City Council finds that the reason for requiring a restrictive covenant no longer exists, and the Millikens should be free to use and sell their property without the limitations imposed by the restrictive covenant, NOW, THEREFORE, BE IT RESOLVED, by the City Council for the City of Port Townsend that the Mayor is authorized to sign the "Release and Extinguishment of Restrictive Covenant" in substantially the form attached hereto.
